c. <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONS <br />REGULAR MEETING <br />AUGUST 17, 2009 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce -Consent Agreement for The Mills at Rocky River Subdivision <br />Project <br />BRIEF SUMMARY: <br />The applicant is Rocky River Project, LLC, 301 S. College Street, 16th <br />Floor, MC 0166, Charlotte, NC 28202. The project consists of 853 single- <br />family residential lots and 347 multi-family residential units on <br />approximately 531 acres located on Rocky River Road. The project was <br />approved by the City of Concord Planning and Zoning Board on <br />December 15, 2005. The project was revised on October 17, 2006. A <br />Consent Agreement is required for this project to proceed. Based on the <br />date of submittal for preliminary plat approval, the Voluntary <br />Mitigation Payment is generated from the pre-August 2007 <br />ordinance. <br />Additional information from the developer has been provided for the Board's <br />consideration. <br />REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />County and Rocky River Project, LLC for The Mills at Rocky <br />River subdivision, including the payment of $4,034 per single-family <br />lot and payment of $1,331 per multi-family unit to advance school <br />adequacy with payment due at final platting and prior to building <br />permitting for the multi-family units. Authorize the County Manager to <br />execute the Agreement on behalf of Cabarrus County, subject to review or <br />revisions by the County Attorney. <br />Page 265 of 315 <br />G-3 <br />
