June 2009 - Planning & Zoning Draft Meeting Minutes <br />The Chair said with that the Vested Rights request. <br />Mr. Koch said it sort of falls in the same category. He said with reference to the vested rights, <br />you would have to show that he has some sort of an approved site plan. <br />The Chair introduced Petition 2009-OZ VR (Accela # PLVR 22009-00001) -Vested Rights <br />Request for Rocky Glen- Randall T. Scribner <br />The Chair asked staff if there was anything additional on that. He said the Board needs to act on <br />it. <br />Mr. Scribner said he needs clarification that we are done here. <br />Ms. Watts addressed the Board stating that this is a request for Vested Rights for the Rocky Glen <br />Subdivision. The developer has requested vested rights, for two years. The requirement for <br />vested rights is: the request must include a description with reasonable certainty, the type and <br />intensity of the use for a specified parcel(s) of land and a site specific plan or phase development <br />plan which shall be in the form of a subdivision plat drawn in accordance with Cabarrus County <br />Subdivision regulations or site development plan drawn in accordance with Chapter Twelve of <br />the Cabarrus County Zoning Ordinance. <br />Ms. Watts said this would run with the land for a period of two years beginning from the date of <br />approval. Any variations from the original plan must have the consent of the Planning and <br />Zoning Commission. The applicant is requesting that vested rights be applied for a period of two <br />years. Should the Board approve the vested rights request, the duration of the vested rights <br />approval would run with the land for a period of two years, beginning June 18, 2009, and <br />expiring on June 18, 2011. Staff recommends the Board consider the information submitted and <br />render a decision accordingly. <br />The Chair asked if there were any questions for staff. There being no questions for staff he asked <br />Mr. Scribner if he had any comments. <br />Mr. Scribner said no. <br />The Chair said it seems we don't have a plat that has been approved plat, we can't approve <br />vested rights. <br />There being no further discussion, Mr. Todd Berg, MOTIONED, SECONDED by Mr. Tommy <br />Porter, to Deny Petition #02009-02 (VR) Request for Vested Rights for Rocky Glen.
