CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />DECEMBER 21, 2009 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce -Request for Revision of Consent Agreement for Waterford on <br />the Rocky River Subdivision (Tabled from November) <br />BRIEF SUMMARY: <br />The developer is Niblock Development Corporation, 300 McGill Avenue <br />NW, Concord, NC 28027. The Waterford on the Rocky River subdivision <br />is approved for 266 single family homes on +/- 162.50 acres and is <br />located between Jim Johnson Road and Shiloh Church Road. The <br />developer is requesting that the timing of the Adequate Public Facilities <br />Payment of $4,034.00 per single famly lot be moved from prior to final <br />platting to building permitting. The original Consent Agreement was <br />approved on September 25, 2005. <br />The County Manager and County Attorney have determined the Consent <br />Agreement for the Waterford on the Rocky River subdivision can be <br />modified administratively to allow the developer, William Niblock, to <br />transfer the APFO mitigation contribution for 36 previously platted (but <br />unbuilt) lots in Phase 1 to 36 as of yet unplatted lots in the next phase.
