RESOLUTION AUTHORIZING ACCEPTANCE OF CONVEYANCE OF CERTAIN REAL PROPERTY AND EXPRESSING APPRECIATION TO CANTERFIELD, LLC WHEREAS, Canterfield, LLC has developed a residential subdivision named Canterfield Estates near Harrisburg in No. 1 Township; and WHEREAS, Canterfield, LLC has set aside a certain amount of open space in that subdivision where the property abuts Rocky River; and WHEREAS, this real property consists of five tracts totaling approximately 37.76 acres; and WHEREAS, this real property is in an area of rapid residential growth and this gift will preserve open space and recreational facilities and allow creation of a greenway upon land that would otherwise be subject to dense development; and WHEREAS, the Board of Commissioners desires to accept the gifr of this real property for the purposes expressed in the deed and to express their appreciation to Canterfield, LLC; and WHEREAS, there are no environmental, legal or other issues involving title to or condition of this real property that would cause the County to decline this gift of real property; NOW, THEREFORE, BE IT RESOLVED by the CABARRUS COUNTY BOARD OF COMMISSIONERS as follows: I. That in behalf of Cabarrus County and its citizens, the Board of Commissioners agrees to accept the conveyance of these five tracts of real property adjacent to Rocky River from Centerfield, LLC for the benefit of its citizens; 2. The County Manager or his designee and the County Attorney are directed to take all action necessary and execute any documents required to represent and protect the County's interest and/or to transfer title of the Properties to the County; and 3. The County acknowledges with much gratitude Centerfield, LLC for its generous donation to the citizens of Cabarrus County. Adopted: This 22nd day of January, 2008.
