Napier RETURN TO: NCDOT, Right of Way Branch 206 Charter SL Albemarle, NC 28001 NORTH CAROLINA STATE HIGHWAY PROJECT: 100.013011 COUNTY OF Cabarrus PARCEL NUMBER: SR 1305007 TAX MAP AND LOT 5508.03.0047 ROUTE: Pitta School Road THIS FEE SIMPLE DEED, made and entered into this the day of February 20 by and between CABARRUS COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF NORTH CAROLI hereinafter referred to as GRANTORS, and the Department of Transportation, an agency of the State of North C hereinafter referred to as the Department; WITNESSETH That the GRANTORS, for themselves, their heirs, successors, and assigns, for and in consideration of the sum of $ 1.00 agreed to be paid by the DEPARTMENT to the GRANTORS, do hereby give, grant and convey unto the DEPARTMENT, its successors and assigns, in FEE SIMPLE that certain properly located in No. 2 Township, Cabarrus County, North Carolina, which is particularly described as follows: IN ADDITION, and for the aforestated consideration, the GRANTORS further hereby convey to the DEPARTMENT, its successors and assigns the following described areas and interests: Beginning at a point in the right of way of Pitts School Road, said point being S 06.04-05 W 9.95 feet from an existing iron pin (mag nail) a corner of Cabarrus County and Furr; thence with the line of Furr and Cabarrus Counmty S 06-04-05 W 43.27 feet to a set iron pin; thence five new lines through Furr's property as follows: 1) N 63-O6-OB W 29.52 feet to a set iron pin; 2) N 72.02.51 W 110.22 feet to a set iron pin; 3) N 69.26.63 W 245.70 feet to a set Iron pin; 4) N 65-33-47 W 45,20 feet to a set iron pin; end 5) N 89-28-Ot W 208.59 feet to a sal iron pin; thence N 20.34.41E 9.97 feet to a point in the existing pavement within the right of way of Pitts School Road; thence with the right Of way of Pitts School Road the following seven (7) lines: 1) S 72-27A9 E 20.00 feet to a point; 2) S 72.24.15E 76.90 feet to a point; 3) S 72-13-23 E 119.67 teat to a point; 4) 5 7z-22.10E 101.62 feet to a point 5) S 72-27-42 E 99.88 feet to a point; 6) S 71-50-05 E 106.95 feet to a point; and 7) S 72-11-34 E 103.72 feet to the point of BEGINNING, containing 0.394 acres more or less as platted and surveyed by Marion L. Sandlin, PLS, December 18, 2003.. SPECIAL PROVISIONS. This deed is subject to the following provisions only: NONE The properly hereinabove described was acquired by the GRANTORS by instrument(s) recorded in the Union County Registry In Deed Book 5247, Page 217 in the Cabarrus County Registry. The GRANTORS by ',the execution of this inslfument acknowledge that the plans for the above referenced project as they affect their remaining property have been fully explained to them or their authorized representative, and they do hereby release the Gfantee, its successors and assigns from any and all claims for damages resulting from the construction of said project orfrom the past, present or future use of said premises herein conveyed for any purpose for which the said Department is authorized by law to subjeIX the Same.
