SMG shall maintain sufficient property damage or loss insurance to oover personal prop- erty owned by SMG at the Facility and shall maintain such insurance beginning as of the date hereof and continuing throughout all periods in which SMG has any operations at the Facility. The County shall maintain its current property insurance covering the premises of the Pacility. Certificates evidencing the exiaterrce of the policies shall be delivered to SMG prior to the com- mencement ofthe Management Term. Notwithstandmg the provisions of this Section 8.5(b), the parties hereto aclmowledge that the above policies may contain exclusions from coverage which are reasonable and customary for policies of such type. With respect to policies procured by it, the Contract Adnriniskator on behalf of the County shall deliver to SMG satisfactory evidence of such renewal of such policies at least twenty (20) days after a policy's expiration date except for any policy expiring on the termination date of this Agreement or thereafter. 8.6 Certain Other Insurance. (s) If any of the pre-Existing Agroomenta consist of agreements with inde- pendent contractore to provide services in respect of the Facility, the County shall use its best efforts to cause such contractors to name SMG as an additional insured under any insurance maintained by such contractors pursuant to the terms of such Pre-Existing Agreements and in such event to deliver to SMG promptly after request therefor a certified copy of such policy and a certificate evidencing the exietettce thereof. In addition, if 5MG enters iMo any agreements during the Management Term and any Renewal Term with auy independent cont<actots for the provision of services hereunder, SMG shall have the right to require such contractors to name SMG as an additional insured under any insurance required by SMG thereunder and to deliver to SMG prior to the perfomrance of such services a certified copy of such policy, plus a certificate evidencing the existence thereof, which policy contains the same type of endorsements and pro- visions ae provided in Section 8.5(c). (b) SMG shall, within ninety (90) days of the date of this Agreement and at least yearly thereafter, review the insurance tamed by the County and SMG covering the Facil- ity or any of SMG's or the County's operations at the Facility, or required of third parties using the Facility, with regard to SMG's experiences at other similar facilities, and shall within fifteen (15) days of such review advise the County in writing of the results of its review and of any changee, additions or increases to the +~~+~*ce requirements hereunder or applicable to third parties which are advisable under beat facility management practices. (c) The parties hereto shall each immediately notify the other, along with any applicable insurance terrier(s), in writing of a~+ occurrence or discovery which could result in an insurance claim hereunder. (d) SMG shall require reasonable flebility insurance from all third-party users of the Facility and ehallenforee the provisions centained in all third party contracts entered into in connection with the Facility, including the insurance requirement contained in all County ap- proved event license, ccnoeasionaire, subcontractor and other similar agreements. 9.
