MEMORANDUM To: Cabarets County Boazd of Commissioners From: Kassie Goodson Watts/Planner Subject: Consent Agreement and School Capacity Information for Rustic Canyon Date: 9/30/2007 The Rustic Canyon subdivision (Phase 2) was approved by the Cabarets County Planning and Zoning Board on June 21, 2007. This subdivision is approved for 238 single family lots on +/-159.19 acres and is located on Zion Church Road. The specifics of the agreement are as follows: • Developer -Shea Homes, LLC, 3436 Toringdon Way, Suite 100, Charlotte, NC 28277. • Payment of $4034 per lot will be due at Final Platting. • Proposed build out schedule is no more than SO lots to be platted in 2009, no more than 50 lots to be platted in 2010, no more than SO lots to be platted in 2011 and no more than 88 lots to be platted in 2012. As a result of the tabling of this proposed Consent Agreement at the August 6, 2007 Board of Commissioners pre-agenda work session meeting, the developer has reduced the number of lots proposed in all years beginning in 2009 to SO lots per year and redistributed the remaining lots to the final year 2012. The developer received a preliminary plat approval for Rustic Canyon (Phase 1) that included 497 single family lots from the Cabarets County Planning and Zoning Boazd on July 20~, 2006. A consent agreement for 4971ots was approved by the Cabarrus County Board of Commissioners on March 26~, 2007 for $4,034 per lot with the following phasing schedule: Calendar year 2007, no more than 35 lots platted; Calendar year 2008, no more than 121 lots platted; Calendar year 2009, no more than 1231ots platted; Calendar year 2010, no more than 1261ots platted; Calendar year 2011, no more than 921ots platted. The total number of units approved for the overall Rustic Canyon subdivision is 735 single family lots. The cumulative total of approved lots platted per the phasing agreements of both consent agreements for the subdivision would be as follows: Calendar year 2007, no more than 35 lots platted; Calendar year 2008, no more than 121 lots platted; Calendar year 2009, no more than 1731ots platted; Calendar year 2010, no more than 1761ots platted; Calendar year 2011, no more than 1421ots platted; Calendar year 2012, no more than 88 lots platted. The revised APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus County Schools indicates that schools impacted by the Rustic Canyon (Phase 2) subdivision axe currently functioning at the following capacities: ~~~
