MEMORANDUM <br />To: Cabarets County Boazd of Commissioners <br />From: Kassie Goodson Watts/Planner <br />Subject: Consent Agreement and School Capacity Information for Rustic Canyon <br />Date: 9/30/2007 <br />The Rustic Canyon subdivision (Phase 2) was approved by the Cabarets County Planning and <br />Zoning Board on June 21, 2007. This subdivision is approved for 238 single family lots on +/-159.19 <br />acres and is located on Zion Church Road. The specifics of the agreement are as follows: <br />• Developer -Shea Homes, LLC, 3436 Toringdon Way, Suite 100, Charlotte, NC 28277. <br />• Payment of $4034 per lot will be due at Final Platting. <br />• Proposed build out schedule is no more than SO lots to be platted in 2009, no more than 50 <br />lots to be platted in 2010, no more than SO lots to be platted in 2011 and no more than 88 <br />lots to be platted in 2012. <br />As a result of the tabling of this proposed Consent Agreement at the August 6, 2007 Board of <br />Commissioners pre-agenda work session meeting, the developer has reduced the number of lots <br />proposed in all years beginning in 2009 to SO lots per year and redistributed the remaining lots to the <br />final year 2012. <br />The developer received a preliminary plat approval for Rustic Canyon (Phase 1) that included 497 <br />single family lots from the Cabarets County Planning and Zoning Boazd on July 20~, 2006. A <br />consent agreement for 4971ots was approved by the Cabarrus County Board of Commissioners on <br />March 26~, 2007 for $4,034 per lot with the following phasing schedule: <br />Calendar year 2007, no more than 35 lots platted; <br />Calendar year 2008, no more than 121 lots platted; <br />Calendar year 2009, no more than 1231ots platted; <br />Calendar year 2010, no more than 1261ots platted; <br />Calendar year 2011, no more than 921ots platted. <br />The total number of units approved for the overall Rustic Canyon subdivision is 735 single family <br />lots. The cumulative total of approved lots platted per the phasing agreements of both consent <br />agreements for the subdivision would be as follows: <br />Calendar year 2007, no more than 35 lots platted; <br />Calendar year 2008, no more than 121 lots platted; <br />Calendar year 2009, no more than 1731ots platted; <br />Calendar year 2010, no more than 1761ots platted; <br />Calendar year 2011, no more than 1421ots platted; <br />Calendar year 2012, no more than 88 lots platted. <br />The revised APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus County Schools <br />indicates that schools impacted by the Rustic Canyon (Phase 2) subdivision axe currently functioning <br />at the following capacities: <br />~~~ <br />
