Carruth <br />Chairman <br />Cabarrus County Board of Commissioners <br />Mr. Chairman, <br />I am writing this note to you in hopes that you would share it with your colleagues on the <br />board at your meeting on Monday. I will not be able to attend personally for obvious <br />reasons as I will be in Raleigh. But I thought it important to briefly address an issue with <br />the board. <br />I would like to answer Mr. Privette's concerns about the "Quick Take" bill that the <br />delegation filed. Mr. Privette seemed to be concerned that we were stepping on property <br />owner's rights. The fact is the cities and county already have powers to take property <br />through eminent domain proceedings for certain authorized purposes. This bill simply <br />gives the cities and the county the same authority that NC DOT currently has to expedite <br />this process for roadwork. Our citizens are very concerned about the traffic issues we <br />face today. Our delegation shares that concern. The land owner would continue to have <br />the same due process remedies available under the current law. <br />The city of Concord requested the legislation, and we thought it best to give the same <br />courtesy to all local governments equally. If the county does not want to be included in <br />this bill, please let us know and we would be glad to remove the county from the bill. <br />We know that your board has used the eminent domain process to acquire property for <br />roadwork for at least two new schools in the past. <br />Thank you, <br />Jeff Barnhart <br />Representative <br />82°d District <br />N.C.
