NOW THEREFORE, in consideration of the mutual agreements hereinafter set forth, <br />and other good and valuable consideration, the receipt and sufficiency of which are hereby <br />acknowledged, County and the City agree as follows: <br />I. DEFINITIONS. The following terms used in this Agreement, unless the context <br />otherwise requires, shall have the meanings set forth below: <br />A. "Governmental Authorities" shall mean the City of Concord, the Water and Sewer <br />Authority of Cabamas County ("W SACC"), the North Carolina Department of Environment <br />and Natural Resources ("DENR"), the State ofNorth Carolina, and any other governmental <br />authorities having jurisdiction over the extensions. <br />B. "Permits" shall mean all applications, petitions, permits, and licenses that are <br />necessary for or appropriate to the construction, installation, ownership, operation, <br />maintenance, repair, and replacement of the water distribution system associated with the <br />extensions to be constructed by City pursuant to this Agreement. <br />To the extent capitalized terms are not defined above, such terms shall have the meaning <br />otherwise ascribed to them in this Agreement. <br />II. WATER DISTRIBUTION SYSTEM IMPROVEMENTS ON MOSS DRIVE. SYBBIE CT. <br />AND DEWITT CT. <br />A. The County shall obtain all easements necessary for the construction and <br />maintenance of the water distribution main on Moss Drive, and any other necessary rights- <br />of-way in the project area. Easements must be granted or obtained and recorded in the name <br />of the City or transferred to the City, both in accordance with the reasonable requirements of <br />the City. The City shall supply the County with the appropriate right-of--way documents for <br />signatures. <br />B. The County shall acquire releases from all private property owners to allow <br />plumbing contractors access to individual properties in the Moss Drive project areas and <br />connect individual water connections from the water meter to the residence. <br />C. The City shall prepare any needed or required engineering plans and specifications <br />for the water distribution system improvement in the Moss Drive project area. The plans <br />and specifications (shall be prepared in accordance with all currently established laws, <br />ordinances, regulations, and policies of the Governmental Authorities. <br />D. The City Engineer or her designee is hereby appointed by the City to review the <br />plans and specifications for the water distribution system improvement, observe the <br />construction thereof, promote communication between the City and County, and to ensure <br />compliance with all applicable laws. <br />E. The City shall apply for the Permits for the Water Distribution System Improvement. <br />The Permits shall'name the City as owner and operator of the water distribution system <br />extension. In the event of any dispute between the City and NC DENR as to the design <br />and/or construction of the Water Distribution Improvement, the stricter standards will <br />control <br />-2- <br />~- ~ ~.. <br />
