The amount of the surcharges will be based upon the volume of flow and the character and concentration of the <br />constituents of the wastewater ~„^^° °^~~^°~~° -°'° '~° °^°^`'°` dischazged in excess of the levels listed above. An <br />industrial user shall never increase the amount of water to dilute pollutant concentrations to avoid or reduce surcharges. <br />(a) The volume of flow used in determining the total dischazge of wastewater for payment of user charges and <br />surcharges shall be based on the following: <br />(1) Metered water consumption as shown in the records of ineter readings maintained by WSACC. If a <br />person dischazging wastewater into the public sewers produces evidence to the Executive Director <br />that a significant percent of the total annual volume of water used for all purposes does not reach the <br />public sewers, then an estimated percentage of total water consumption to be used in determining <br />non-domestic wastewater discharge may be agreed upon between the Executive Director and the <br />person dischazging such non-domestic wastewater into the public sewer. The Executive Director shall <br />ascertain whether substantial evidence has been provided to prove a significant percent of water does <br />not reach the public sewers; or <br />(2) If required by WSACC or at the individual dischazges option, other flow monitoring devices which <br />measure the actual volume of wastewater dischazged to the sewer. Such devices shall be accessible <br />and safely located, and the measuring system shall be installed in accordarice with plans approved by <br />WSACC and the eovemine municipalitv. The metering system shall be installed and maintained at the <br />users expense according to amangemenu that may be made with W SACC. <br />(3) Where any user procures all or part of his water supply from sources other than WSACC, the user <br />shall install and maintain at his own expense water meters of a type approved by WSACC for the <br />purposes of determining the proper volume of wastewater dischazged to such sewers. <br />(b) The chazacter and concentration of the constituenu of wastewater used in determining surcharges shall be <br />determined by samples collected and analyzed by WSACC. Samples shall be collected in such manner as to be <br />representative of the actual discharge and shall be analyzed using procedures set forth in 40 CFR Part 136. <br />(c) The determination by the Executive Director or his duly appointed representatives of the character and <br />concentration of the wastewater dischazge shall be binding as a basis for chazges. <br />(d) Any source that dischazges non-domestic wastewater in excess of the levels listed above may be subject to <br />surcharges. <br />(e) The Exewtive D'uector may assess surcharges to users to recover any additional costs incurred by WSACC for <br />the handling and disposal of sludge. <br />3.4 Pretreatment Pro¢ram Administration Charees <br />The schedule of charges and fees adopted by WSACC may include chazges and fees for. <br />(a) reimbursement of costs of setting up and operating the pretreatrnent program; <br />(b) monitoring, inspections and surveillarice procedures; <br />(c) reviewing slug control plans, includine accidental and/or slue load discharge procedures and construction plans <br />and specifications; <br />23 <br />G -'-I <br />
