(b) Anv industrial user nroaosin¢ to change the volume or characteristics of an existi~g dischazee shall request <br />from WSACC a determination as to whether or not a new application should be filed and shall provide <br />sufficient information on the proposed change to enable WSACC to determine the need for a new application. <br />If the proposed chanee requires a revision in a current SIU or local permit or requires a different type of permit <br />be issued the user shall apply to WSACC for an appronriate wastewater discharge_permit within 45 davs of the <br />notification. <br />(c) When requested by the Executive Director, a user must submit information on the nature and chazacteristics of <br />its wastewater within thirty (30) days of the request. The Exewtive D'uector is authorized to prepare a form for <br />this purpose and may periodically require users to update this information. <br />(d) Mv oerson dischareine or proposin¢ to dischazge wastewater into the POTW shall be responsible at all times <br />for determinin¢ the volume and characteristics of iu existine or pronosed dischaz~e. <br />4.2 Wastewater Dischar¢e Permits-Requirements <br />fal(Il All nersons meetin¢ one or more of_the reauiremenu of an SIU of this ordinance ' <br />shall obtain an ~t industrial user urelreatment permit prior to the commencement of conslruction or <br />operations which will result in a discharge to the POTW. Existing industrial users who aze determined by the <br />Executive Director to be SIUs ' shall obtain a signif~sant induslrial user nretreatment <br />permit within 180 days of receiving notification of the Executive Director's determination. <br />For purposes of this definition, construction or operation has commenced if the owner or operator has: <br />(i) Begun, or caused to begin as part of a cominuous on-site conshvction program: <br />(A) Any placement, assembly, or installation of facilities or equipment; or <br />(B) Significant site preparation work including cleazing, excavation, or removal or existing <br />buildings, structures, or facilities which is necessary for the replacement, assembly, or <br />installation of new source facilities or equipment; or <br />(ii) Entered into a binding contractual obligation for the purchase of facilities or equipment which aze <br />intended to be used in its operation within a reasonable time. Options to purchase or contracu which <br />can be terminated or modified without substantial obligation under this definition in accordance with <br />that Section with the provisions as stated in 40 CFR 4033.(K). <br />(2) ~uskia4 Users who do not fit the SIU criteria may at the discretion of the Executive Director be required to <br />obtain a~~aste~vete~-~issHa~ge local pretreatment permit as <br />necessarv to ca orr~ut the purposes of this ordinance. <br />(3) Anv violation of the terms and/or conditions of a wastewater dischazee aermit shall be deemed a violation of <br />this ordinance Obtainin~ a wastewater dischazge_permit does not relieve a Permittee of the continuine <br />oblieation to complv with all Federal and State pretreatment standazds and/or requirements or with anv other <br />reauirements of Federal, State and local law. <br />(b) Sipnificant Industrial User Determination <br />All persons proposing to discharge non-domestic wastewater, or proposing to change the volume or <br />25 <br />l3"' ~ <br />
