(I) The Executive Director is authorized to establish one or more eeneral conditions for inclusion in all wastewater discharee nermits. In addition, the Executive Director is authorized to desie,nate one or more classes of users and mav establish one or more limited conditions for inclusion in all wastewater discharge_permits issued to users in a designated class. (2) In desi~nating a class, the Exewtive Director shall identifv one or more common factors characterizing the members of such class and determine that at least five (5) permitted users satisfv all of such factors Before a condition established or class desienated nursuant to this subsection may take effect written notice of such condition or class shall be eiven to aIl users holdine a nermit at the time that such condition or class is proposed and such users shall be allowed at least 30 davs within which to submit written commenu to the Executive Director. Thereafter, the Executive D'uector mav make such condition or class effective without modification or mav modifv such condition or class without further notice to any person. (3) For each condition established pursuant to this subsection, the Executive Director shall determine the effective date thereof From and after the effective date of each condition established pursuant to this subsection everv wastewater dischazee permit which is issued, renewed, amended, or otherwise modified shall contain~ everv eeneral condition which remains in effect; and, for each user in one or more classes desi ~~ aa ted pursuant to this subsection, everv apnlicable limited condition. (~ Ehj Adjudicatorv Hearine (I) Persons entitled to hearine The followine persons are entitled to a hearingpursuant to this section: (a) an applicant for a wastewater discharee permit or other permit required bv this ordinance who is denied a permit or is ¢ranted a permit subject to condiNons which are unacceptable to the applicant; (b) a user who is assessed a civil penaltypursuant to Section 8.2; (c) a user to whom an order is issued »ursuant to Section 8.1(d) or (e).
