(1) such nerson is not delinauent in pavine anv water or sewer bill; (2) full pavment has been made for al] costs incurred by WSACC in removine, severing or otherwise discontinuine water or sewer service to such person: (3) full ~ayment has been made for fees and costs associated with providine the requested service and installine the necessarv facilities; (4) full payment has been made for all civil oenalties assessed aeainst such person nursuant to this ordinance and for all damages to the POTW which such person is required to pay by the provisions of this ordinance• (5) if such uerson is reauired to have a wastewater dischar~e permit before dischazeine wastewater into the POTW, such person must apply for and accent a wastewater dischazee nermit containine such provisions as WSACC determines to be reasonablv necessary. The nrovisions of Section 43 (fl will not apply to the denial of a permit to such person or to erantin¢ a oermit subject to conditions unacceptable to such person. (c) This section shall applv to everv application for water or sewer service bv anv person subject to Section 16 (al made within 2 years after water or sewer service has been terminated nursuant to this ordinance. (d) Anv aerson aunlvine for a connection to nrovide water or sewer service to all or anv roortion of the orooertv served bv a connection removed pursuant to anv provision of this ordinance shall be reouired to pav all fees and charpes for securine a new connection, without exception. Mv fee or chazee naid prior to the removal of the service connection shall be forfeited in its enfvety and shall have no continued effect. SECTION 12 - TAMPERING WITH, DAMAGING SEWERAGE WORKS No person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any materials, structure, appurtenance or equipment which is a part of the wastewater lreatment system or bebn~s to WSACC, including that left upon the premises of a user discharging wastewater into the POTW. The user shall be resnonsible for the safetv of such eauiament and may be held liable in the event of anv such damage. SECTION 13 - FALSIFYING INFORMATION; DAMAGE TO MONITORING EQUIPMENT Anv oerson who knowinelv makes anv false statemenu, renresentation or certification in anv a~nlication, record. reoort plan or other document filed or required to be maintained pursuant to this ordinance or wastewater discharee nermit. or who falsifies, tampers with or knowin~lv renders inaccurate anv monitorin~ device or method reauired under this ordinance, shall, uaon conviction, be punished bv a fine of not more than five hundred dollazs ($500.00) or bv imnrisonment for not more than six (6) months, or bv both SECTION 14 - NEW CONSTRUCTION New sewers and new connections shall be properly designated and constructed in accordance with such guidelines as pub]ished by the Environmental Protection Agency, reference 40 CFR section 35.927-4. All new connections shall conform with the North Cazolina plumbing codes. 55 (j"~
