a ~, ti i ...~.o...,:a:..~.ii <br />SECTION 18 - SPECIAL AGREEMENTS <br />Nothing in this ordinance shall be conshved as preventing any special ageement or arrangement between the Boazd of <br />Directors and any user of the wastewater treatment system whereby wastewater of unusual strength, character or <br />quantity is accepted into the system and specially treated subject to any payments or user chazges as may be applicable, <br />provided such wastewater will not interfere with the treatment process, sludge disposal options, NPDES permit <br />compliance or cause a violation of water qualiry standards. <br />SECTION 19 - SEVERABILITY <br />If any provision, pazagraph, word, section or article of this ordinance is invalidated by any court of competent <br />jurisdiction, the remaining provisions, paragraphs, words, sections, and chapters shall not be affected and shall continue <br />in full force and effect. <br />SECTION 20 - CONFLICT <br />All other ordinances and parts of other ordinances inconsistent or conflicting with any part of this ordinance are hereby <br />repealed to the extent of such inconsistency or conflict. <br />SECTION 21- PUBLIC NOTIF[CATION OF UNTREATED WASTE AND <br />WASTEWATER DISCHARGES <br />(a) All wastewater spills that reach the surface waters (re~ardless of volume) and all soills to the Pround surface <br />exceedin~ l 000 eallons (reeazdless of whether thev aze contained or reach surface waters) should be reoorted <br />by the dischar¢er to the State's Departrnent of Environment and Natural Resources reeional office. <br />(b) Whenever a dischazee of untreated wastewater of 1 000 eallons or more reaches surface waters, a press release <br />must be sent bv the dischaz¢er to all print and electronic news media providina eeneral coveraee in the countv <br />where the dischazee occurred The press release is to be issued within 48 hours of the determination that the <br />wastewater has reached surface waters A couv of the uress release and a list of the media to which it was <br />distributed must be kept on file bv the user for at least one veaz and copies made available unon reauest. <br />(c) If the untreated discharee to the surface waters is I5,000 eallons or more, the dischazeer must issue a oress <br />release and a notice of the dischar~e must be published in a news~aper with general circulation in the counri <br />where the discharze occurred and in each countv downstream that is si~ificantlv affected. The Secretarv of the <br />Denarhnent of Environment and Natural Resources determines which counties are simificantlv affected, and <br />publication must occur within 10 davs of this determination and DENR's approval of the form and content of <br />the notice and the news~apers in which it is to be aublished. <br />57 <br />~~~ <br />
