Memo <br />To: Cabarrus County Board of Commissioners <br />From: Susie Zakraisek, AICP, Planning and Zoning Manager <br />CC: File <br />Date: August 27, 2007 <br />Re: Text Amendment C2007-08-ZT-Wireless Telecommunication Services <br />Attached you will find proposed changes to the existing text far the regulation of Wireless Telecommunication Services. <br />Senate Bill 831, ratified on August 2, 2007, includes several changes regarding the regulation of Wireless <br />Telecommunications Services as well as criteria for streamlining and simplifying some of the review processes <br />associated with Wireless Telecommunication Services. Because of the changes in the statutes, the current language <br />in the Cabarrus County Zoning Ordinance needs to be amended to reflect the changes in the state statutes. <br />Changes to the statutes include that criterion for review of new wireless telecommunications services towers address <br />public safety, land development and zoning issues only. The changes prevent development review agencies from <br />requiring information on or evaluating an applicant's business decisions about its designed service, customer demand <br />for its service or quality to or from a particular area or site. The changes also permd government review agencies to <br />charge fees that are considered "usual and customary' and fixed in advance. Regarding co-locations, the bill <br />establishes that processes for co-locations should be more streamlined and that reviews must have time limits. <br />The last, but possibly most notable change as a result of the legislation is that condtional use permits issued for these <br />types of projects are valid for a minimum of 2 years. This is a significant change since most conditional use permit <br />processes limit the life of the conditional use permit to one year. <br />The Planning and Zoning Commission voted unanimously to adopt the standards on August 16, 2007. <br />Please review the materials and be prepared to vote on the proposed revisions to the Cabarrus County Zoning <br />Ordinance. <br />G-3 <br />
