Memo <br />To: Cabarrus Board of Commissioners <br />From: Susie Zakraisek, AICP, Planning and Zoning Manager <br />CG' File <br />Date: October 2, 2007 <br />Re: Text Amendment C2007-O6-ZT-Amenity Subdivision Standards and Anti-Monotony <br />Standards <br />Since the adoption of the architectural standards for amenity subdivisions and the addition of anti- <br />monotony standards in June of 2005, staff has found the current language in the zoning ordinance to <br />be difficult to enforce, and in some instances, not in keeping with standard architectural practice. Staff <br />discussed the standards with the Planning and Zoning Commission several times to try and find <br />solutions to the difficulties of enforcing the standards as written. Additionally, staff met with Mr. Todd <br />Berg, a member of the Planning and Zoning Board and an architect by trade, to seek guidance <br />regarding the application of the standards. As a result of those meetings and discussions with the <br />Planning and Zoning Commission, staff proposed text changes to the Planning and Zoning <br />Commission at the May meeting. At that time, more discussion took place regarding the standards <br />and the Planning and Zoning Chair appointed a committee to review the proposed changes and to <br />see what, if any, alternatives could be fdund. <br />The appointed Architectural Committee consisted of four members of the Planning and Zoning <br />Commission, Mr. Larry Griffin, Mr. Todd Berg, Mr. Ian Prince and Mr. Tommy Porter. The Committee <br />met on June 5, 2007 to discuss the proposed text amendment. The text amendment language <br />proposed by the Architectural Committee was submitted to the Planning and Zoning Commission at <br />the June meeting. The Planning and Zoning Commission voted unanimously to forward the proposed <br />amendment to the Cabarrus County Board of Commissioners for final consideration. <br />When the County Manager was presented with this item for the July Board of Commissioners <br />meeting, he requested that additional input on the proposed changes be solicited from the community. <br />As a result, a new committee was formed to review the proposed text. Members of the committee <br />represented local architects, builders and developers. The committee members were Mr. Todd Berg <br />of Morris-Berg Architects, Mr. Gaillard Mervin of Liles Construction, Mr. Grady Cook of Grady Cook <br />Development and Mr. David McClellan of McClellan Design. The committee met on August 30~', <br />2007. After much discussion, the Review Committee decided that the proposed changes were <br />appropriate and in keeping with the intent of the ordinance and that the proposed changes should be <br />presented to the County Commissioners for consideration. <br />Attached you will find the proposed changes to Chapter 5 of the Cabarrus County Zoning Ordinance. <br />The proposed changes are a direct result of the meetings and discussions of the Planning and Zoning <br />Architectural Committee and the Review Committee. The proposed changes have been reviewed by <br />the County Attorney. <br />Please read over the attached materials and be prepared to hold a public hearing regarding the <br />proposed text amendment. <br />tZ ` <br />
