STATE OF NORTH CAROLINA ) PIN # 5544261561 Grant of Right of Way and Easement to COUNTY OF CABARRUS ) BETHEL UNITED METHODIST CHURCH The undersigned Grantor, in consideration of payment to the Grantor of the sum of $5,000.00, the receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell and release unto Bethel United Methodist Church ("Grantee"), its successors, assigns and licenses (as limited below), the right, privilege, right of way and easement to enter and re-enter at any time and to install, dig, build, erect, maintain, iepair, rebuild, operate, and patrol one sanitary sewer force main, underground, including but not limited to, the right to install sewer pipes and related appurtenances; the right to clear the right of way and easement and keep it clear of brushes, trees, obstructions, and fire hazards; the above described rights being incident to performance by the Grantee as the operator of a pump station and force main, or the performance by any licensee of the Grantee of any maintenance functions, the premises to be affected being as follows: DESCRIPTION OF RIGHT OF WAY AND EASEMENT That Portion of Land so labeled on the map attached hereto and incorporated herein by reference, said map having been prepared by NorStar Land Surveying, Inc. for Bethel United Methodist Church. Map entitled Proposed 20' Permanent Force Main Easement for: Bethel UMC PIN #5544261561 Township No. 10 Cabarrus County, NC. Together with any and all rights normally incident thereto, and particularly the right of ingress and egress thereto from time to time as necessary for construction, reconstruction, and/or maintenance. To have and to hold the same unto Bethel United Methodist Church, its successors and assigns (as limited below) forever. Grantor shall have the right to use the above-described strip for purposes not inconsistent with Grantee's full enjoyment of the rights hereby granted, including, without limitation, the right to construct, repair and maintain access driveways over and across the above-described strip of land. Grantee, shall be obligated, at its own expense, to repair and/or replace any existing landscaping, signs, driveways, utility lines and other improvements that are in any way disturbed or damaged as a result of any construction, repair or maintenance of the sanitary sewer force main constructed within the above-described strip of land.
