STATE OF NORTH CAROLINA ) PIN # 5544261561 <br />Grant of Right of Way and Easement to <br />COUNTY OF CABARRUS ) BETHEL UNITED METHODIST CHURCH <br />The undersigned Grantor, in consideration of payment to the Grantor of the sum of $5,000.00, <br />the receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell and release <br />unto Bethel United Methodist Church ("Grantee"), its successors, assigns and licenses (as limited <br />below), the right, privilege, right of way and easement to enter and re-enter at any time and to install, dig, <br />build, erect, maintain, iepair, rebuild, operate, and patrol one sanitary sewer force main, underground, <br />including but not limited to, the right to install sewer pipes and related appurtenances; the right to clear <br />the right of way and easement and keep it clear of brushes, trees, obstructions, and fire hazards; the above <br />described rights being incident to performance by the Grantee as the operator of a pump station and force <br />main, or the performance by any licensee of the Grantee of any maintenance functions, the premises to be <br />affected being as follows: <br />DESCRIPTION OF RIGHT OF WAY AND EASEMENT <br />That Portion of Land so labeled on the map attached hereto and incorporated herein by reference, <br />said map having been prepared by NorStar Land Surveying, Inc. for Bethel United Methodist <br />Church. Map entitled Proposed 20' Permanent Force Main Easement for: Bethel UMC PIN <br />#5544261561 Township No. 10 Cabarrus County, NC. <br />Together with any and all rights normally incident thereto, and particularly the right of ingress <br />and egress thereto from time to time as necessary for construction, reconstruction, and/or maintenance. <br />To have and to hold the same unto Bethel United Methodist Church, its successors and assigns <br />(as limited below) forever. <br />Grantor shall have the right to use the above-described strip for purposes not inconsistent with <br />Grantee's full enjoyment of the rights hereby granted, including, without limitation, the right to <br />construct, repair and maintain access driveways over and across the above-described strip of land. <br />Grantee, shall be obligated, at its own expense, to repair and/or replace any existing landscaping, <br />signs, driveways, utility lines and other improvements that are in any way disturbed or damaged as a <br />result of any construction, repair or maintenance of the sanitary sewer force main constructed within the <br />above-described strip of land.
