<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />PLANNING STAFF REPORT <br />TO CABARRUS COUNTY BOARD OF COMMISSIONERS <br />Monday, February 20th, 2006 <br /> <br />Petition: C2006-01 (ZT) <br /> <br />Purpose: This text amendment is in response to a citizen's request to build an attached garage onto <br />his home in the Cessna Springs subdivision. The property was rezoned in the June 2005 mass rezoning <br />from Cabarrus County MDR-Medium Density Residential to Cabarrus County CR-Countryside <br />Residential. Under the previous zoning, the sideyard setbacks were 5 (single) and 20 (total), i.e. the <br />principal structure could sit as close as 5 feet to the property line, but the combined total of the sideyard <br />setbacks required was 20 feet. The petitioner sought a building permit to start construction on the attached <br />garage, only to learn that the setbacks would not permit the addition. The petitioner is requesting to <br />amend the sideyard setbacks in the CR-Countryside Residential district from 20 (single) and 40 (total) to <br />10 (single) and 40 (total). Approval of this amendment will effect the following change: <br /> <br />1. It will also allow for more <br />flexibility in structural placement in the CR district while still retaining the total sideyard <br />setback requirement of 40 feet. On January 19th, 2006 the Cabarrus County Planning and <br />Zoning Board voted unanimously to recommend approval of this text amendment to the <br />Board of Commissioners. <br /> <br />Staff Recommendation: Planning Staff recommends APPROVAL of petition C2006-0 1 (ZT). <br /> <br /> <br />G.~ <br />
