MEMORANDUM

TO: John D. Day/Cabarrus County Manager

FROM: Mike Byrd/Commerce Department

DATE: May 24,2006

SUBJECT: NCDOT maintenance/right-of-way abandomnent for a portion of
Macedonia Church Road (SR 1620)

Attached are several items regarding the subject above:

1. A letter from Mr. Ritchie Hearne, NCDOT District Engineer. This letter asks the
Commissioners request, by resolution, that NCDOT abandon a portion (.10 mile)
of Macedonia Church Road described in his letter.

2. The letter from the property owners on Macedonia Church to Mr. Hearn
requesting the abandomnent, and the abandomnent form used by NCDOT

3. A map showing the location of Macedonia Church Road, and the portion being
requested for abandomnent.

4. A resolution the Commissioners would need to approve to request the
abandomnent.

If the Commissioners approve the resolution for abandomnent, the County would then
need to forward this resolution to the North Carolina Board of Transportation. The Board
of Transportation approval of the request would then require the County to conduct a
public hearing on the abandomnent of the right-of-way.

This hearing would require the posting of that portion of the right-of-way, and legal
notice of the hearing advertised in the paper. It is our recommendation that the property
owners involved with this request pay the cost of advertising.

If you have any questions, please let me know.

F-L~
