RESOLUTION OF THE CABARRUS COUNTY BOARD OF EDUCATION WHEREAS, the Cabarrus County Board of Education is constructing two elementary schools known as C.A. Furr Elementary and Charles E. Boger Elementary and also a high school known as Hickory Ridge High School located on certain tracts of real estate referred to herein as the "Property(ies)"; and WHEREAS, the Board of Education and the Cabarrus Board of County Commissioners has determined that it is in the best interest of both parties that title to these three Properties be held in the name of Cabarrus County nunc pro tunc July 1, 2005 (or the date the Board of Education obtained title to the Property); and WHEREAS, the parties have agreed that the Board of Education will lease the Properties from the County and act as the County's agent to supervise construction; NOW, THEREFORE, BE IT RESOLVED THAT the Cabarrus County Board of Education does hereby resolve as follows: (I) Title to the Properties commonly known as C.A. Furr Elementary, Charles E. Boger Elementary and Hickory Ridge High School is hereby transferred to the County of Cabarrus, North Carolina nunc pro tunc as of July 1, 2005, or the date the Board of Education obtained title to the Property. The Board attorneys are directed to file appropriate papers transferring title of these Properties to the County; and (2) The County approves the Lease attached to this Resolution as Exhibit A nunc pro tunc as oOuly 1, 2005; and (3) The Board of Education approves the Agency Agreement attached to this Resolution as Exhibit B nunc pro tunc as of July 1,2005; and (4) The Board's attorneys are directed to take whatever action is necessary to effect a transfer of the properties nunc pro time as of July 1, 2005.
