(hereinafter referred to as the "County") and the . <br />Centralina Council of Governments (for services provided by its Area AllenCy on <br />Allinlll, (hereinafter referred to as the "Council"); <br />WITNESSETH THAT: . <br /> <br />. . <br />WHEREAS, the Council wishes to have performed and the County wishes to provide <br />certain aging services in connection with. activities financed . in part by Older <br />Americans Act grant funds provided to the Council from the Vnited States Department <br />"ofHealthand-Human-SlnVices-1hrough-the"North Carotina-oivision-ot Aging and Adult <br />Services; <br /> <br />NOW THEREFORE, in consideration of the premises, and mutual covenants and <br />agreements hereinafter contained, the parties hereto agree as.follows: <br />~ . ... . -. <br /> <br />1. Employment of the AllenCy. The Councirnerebyagreesto~engage the County <br />and the County hereby agrells to perform the services hereinafter set forth in <br />accordance with the terms and conditions contained herein. <br /> <br />2. Scope of Services. The County shall provide Home and Community Care Block <br />Grant services to individuals who are 60 years of age or older residing in <br />Caba.rrus County. All services are to be performed in accordance with the <br />County's Home and Community Block Grant Funding Plan submitted to the <br />Council, the terinsof which arilincorporated herein by reference. In addition, <br />the County agrees to perform services in full compliance with NC Home and <br />Community Care Block Grant requirements .' and the Centralina Council of <br />Governments Area Agency on Aging Home and Community Care' Block Grant <br />Program Procedures. Manual. dated July. 2006, the terms of which are <br />incorporated herein by reference and copies of which have been furnished to <br />the County. <br /> <br />3. Time of Performance. The services of the County are to commence no later <br />than July 1. 2006 and shall be undertaken and pursued in such sequence as to <br />assure their expeditious completion on or before the end of the contract period, <br />June 30. 2007. <br /> <br />4. Contract Administrator. The contract administrator for the Council shall be <br />Gayla S. Woody. Aainll Prollram Administrator. or such other staff personnel <br />as may be designated by the Council. The contract administrator for the County <br />shall be Mike Mutphy. Department of Allina Director or such other staff <br />personnel as may be designated by the County. It is understood and agreed <br />that the administrator for the County shall represent the County in. the <br />performance of this contract. The County or the Council shall notify the other <br />party if the administrator changes during the contract period. <br /> <br />5. Compensation and Method of Payment. The County shall be compensated for <br />the work and services actually performed under this contract by payments to be <br />made monthly by the Council. However, the total compensation and <br />reimbursement to be paid the County under this contract shall not exceed the <br />sum of $ 580514 in grant funds. The request for reimbursement may only <br />include purchases in compliance with the Centralina Area Agency on Aging <br />Home and Community Care Block Grant Procedures and receipts for <br /> <br />r,/~ <br />
