Title af Article. <br />This Article may be c~ed as the Animal WelfareAcl. (1977, 2nd Sess., c. 1217, s. 1.) <br /> <br />~19A-21. Purpases. <br /> <br />The purpases af this Article are (i) to. pratect the awners af dags and cats fram the theft af such pets; (iI) to. <br />prevent the sale ar use of stalen pets; (iii) to. insure that animals, as ~ems af commerce, are pravided humane' <br />care and treatment by regulating the transpartatian, sale, purchase, hausing, care, handling and treatment af <br />such animals by persans ar arganizatians engaged in transparting, buying, ar selling thern <br />for such use; (Iv)ta insure that animals canfined in pet shaps, kennels, animal shellers and auctian markels are <br />pravided humane care and treatment; (v) to. prahib~ the sale, trade ar adaptian af thase animals which shaw <br />physical signs af infectian, cammunicable disease, ar cangenital abnarmalities, unless veterinary care is <br />assured subsequent to. sale, trade ar adaptian. AnlmalWelfare Sectlan In Animal Health Dlvlslan af Department af Agriculture and Cansumer <br />Services created; Dlrectar. <br /> <br />There is hereby created within the Animal Health Divisian af the Narth Caralina Department af Agriculture <br />and Cansumer Services, a new sectian thereaf, to. be knawn as the Animal Welfare Sectian af said divisian. <br />The Cammisslaner af Agriculture is hereby autharized to. appaint a Directar af said sectian whase duties and <br />authar~ shall be determined by the Cammissianer subject to. the appraval af the Baard af Agriculture and <br />subJectta the pravisians afthis Article. (1977, 2nd Sess., c.1217, s. 3; 1997-261, s. 1.) <br /> <br />~ 19A-23. Definltlans. <br /> <br />Far the purpases af this Article, the fallawing tE!rms, when used in the Articlear the rules ar arders made <br />pursuant thereto., shall be canstrued respectively to. mean: <br />(1) "Adequate feed" means the pravisian alsuitable intervals, natta exceed 24 haurs, af a quantity af <br />whalesame faadstuff suitable far the species and age, sufficient to. maintain a reasanable level af <br />nutritian in each animal. Such faadstuff shall be served in a sanitizE!dreceptacle, dish, ar cOniaimir <br />(2) "Adequate water" means a canstant access to. a supply af clean, fresh; patable water pravided In a <br />sanitary manner ar pravided at suitable intervals far the species and nat to. exceed 24 haurs at any <br />interval. <br />(3) "Ambient temperature" means the temperature surraunding thE! animal. <br />(4) "Animal" means any damestic dag (Canis familiarls), damE!stic cat (Felis damestica). <br />(5) "Animal shelter" means a facil~ which is used to. hausE! ar cantain animals and which is awnE!d, <br />aperated, ar maintained bya dulylncorparated humane saciety, animal-welfare society, so<:ietyfar <br />the preventian af 'cruelty to. animals, aralher nanprafit organizatiandevated to. the welfare; <br />pratection and humane treatment af animals. <br />(sa) "Baarding kennel" means a facility ar establishment which regularly affers to. the public the <br />service af baarding dags ar cats ar bath far a fee.
