" .. - .---,,- ,,- .n__..". _. . <br /> <br />THIS AGREEMENT TO IHODIFY A!'{D Al\lEND LEASE AGREE~lENT is made <br />and entered into this the ~ day of December, 2002, by and between the COUNTY OF <br />CABARRUS (hereafter, "County") and the CA..BARRUS COUNTY BOYS & GIRLS CLUB, <br />INC. (hereafter, the "Club"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, on or about April 15, 2002, the County and the Club entered into a Lease <br />Agreement, a copy of which is attached hereto as Schedule 1 and mcorporated as if more fully <br />set forth herein (hereafter, the "Lease") providing for the lease of certam property from the Club <br />to the County beginnmg July 1, 2002, for purposes of providing recreational services to County <br />citIzens (the "Property"); and <br /> <br />\^lHEREAS, in order to receive certain grants available to the County through the North <br />Carolma Parks and RecreatIOn Trust Fund ("P,ARTF"), the parties must amend the tenn <br />provisions of the Lease and the County and the Club desire to so amend the Lease; <br /> <br />NOW, THEREFORE, m consideration of the premises and other good and valuable <br />consideratlOn, acknowledged by the parties hereto to be sufficient, the partIes agree as follows: <br /> <br />1. Section 1.1 Amended. The parties hereto agree that Section 1 1 of the Lease is <br />hereby modified and amended in its entirety to read as follows: <br /> <br />U Lease of the Property. Beginning July 1, 2002, the parties hereby agree that the <br />County shall lease the Property from the Club through June 30, 2003 at a rent of $100 for such <br />term, payable in advance. Thereafter, the County shall lease the Property from the Club for a <br />penod of25 years beginning July 1,2003 through June 30, 2028, at an annual rent of$1.00 per <br />year, payable in advance. The Property shall be used for camp development and recreational <br />purposes. The County shall not be permItted to enter into any subleases of the Property without <br />written consent of the Club. However, use of the Property as a public facility, as set forth herein, <br />WhICh may from time to time result in third party use of the Property for a fee, shall not be <br />construed as subletting for purposes of this agreement. <br /> <br />2. Miscellaneous. The parties agree 1) to execute all necessary documentation <br />needed from time to time in order to properly apply for cCliain grants available to the County <br />wIth regard to the Property, includmg without limitation, state funds available through PAR TF; <br />and 2) to enter into and record a Memorandum of Lease which sets forth the modIfied term of the <br />Lease, which Memorandum of Lease is attached hereto as Schedule 2 and incorporated as if <br />more fully set forth herein. <br /> <br />3.
