Suite K, Charlotte, NC 28203 the owners of the project more fully <br />defined below(.D8~elap8r.1 and Cabarrus County, Noreh Carolina, a political <br />subdivision of the State of North_ Carolina_, ...ith its principal place of <br />business at 65 Church Street, BE, concord, North Carolina 28025 (hereafter, the <br />: .countY'" or .Cabar:rL1-S COUJ;l.ty") by and througbits _Cabarrus .County Board .of <br />Corlmissioners. .". . <br /> <br />RECITALS: <br /> <br />A. .Developer.is the oWner of approximately 25.62 acres of real property <br />located in the City of .Concord, Cabarrus c~unty, and has proposed the <br />..development of a subdivision in that location -with a maximum of 76 single <br />{amily lots, currently known as the Mountain Laurel subdivision proj~ct (the <br />"projec,t"l_,_ to be constructed in multiple phases. " <br /> <br />B. The Project ~s-subject to the Adequate Facilities Provisions of the <br />Cabarrus County SubdivisionOrdinance,~hapter 4 Section. 17, and to best <br />knowledge-of the Couney, has been ~eviewed by all pub~ic agencies ...hich may <br />potentially. serve the Project and its future reli!idents. <br /> <br />.C:. Developer is willing to-advance .public services and facilities for the <br />project and to agree to certain other considerations to address Cabarrus County <br />aqequate facility standard~ and advance these services and facilitie~. <br /> <br />D. ~abarrus county, acting pursuant to i~ ,authority undcrG.S. 153A-330 <br />.to 335 ,and the -applicable provisions of the Cabarrus County Subdivision <br />Regulations, has made certain determinations with respect to the proposed <br />Project, and, in the exercise of its legislative-~iscretion, has elected to. <br />process the Project, resulting in the negotiation, consideration and approval <br />of this Consent Agr~ement after all necessary hearings. <br /> <br />CABARR'OS COUNTY AND THE DEVELOPER HEREBY AGREE ,AS FOLr,.OWS: <br /> <br />1. The .project <br /> <br />1.1 DescriPtion of Proiect. The Mountain Laurel project covered by this <br />Consent Agreement consists of a single-family subdivision with-16 lots located <br />on approximately :5.62 acres in City of Concord, North Carolina and has a <br />density not exceed 3,.14 as Shown on the approved preliminary subdivision plan. <br />Any changes in such approval must be approved in _accordance with_the City of <br />Concord Unified Development .Ordinance (UDO) or its _successor in interest. <br /> <br />1.: Leqal Description of -Property. The map description of the -land <br />.covered by the project is attachedhcreto as Exhibit A and incorporated into <br />this Consent Agreement by this reference (the -~Property.l. No property may be <br />added to the map.description for purposes of this Consent Agreement, except by <br />written amendment. Except as- expressly set forth in this Agreement -with <br />respect to off-property road improvements, this Consent Agreement -shall-not <br />affect any land other th~ the Property. <br /> <br />1.3 Apcroved Use and Density.
