The approval and development of this Project is <br />subject to the following conditions, as agreed. upon by, the Developer and <br />Cabarrus County Bo~rdof Commissioners: <br /> <br />A) paynjent of $10,08.00 per single family lot, to advance school <br />adequacy, which wi~l be adjusted annually for inflation in accordance with a <br />policy established ~nd adopted from time to time by the Cabarru8 County Board <br />of Commissioners. Total payment for the currant approved project is $434448.00. <br /> <br />8.) Summary of Cabarrus County Determinations Relating 'to the <br />Project. <br /> <br />The Board of: Commissioners of Cabarrus County" a,cting in its legislative <br />capacity, has made ~he following determinations with respect to the project, <br />including all findirgs, of fact and law as are necessary to make each of the <br />followingdetermin~tions:: <br />2.1 County Determinations Relatinq to the Project. <br /> <br />2.1.1 Permit Approvals; The Project has received an approval recommendation, <br />with the conditionsl:staff recommended,' on the preliminary plat by action of the <br />.City of Concord plapningand zoning Board taken on January 18th, 2005. <br /> <br />2.2 Recoqnized Ri~hts In Base AdeQUate FacilitY'Fee. <br /> <br />2.2.1.ReCOqnized,Ri~. Subject to ,Section 1~5.A, the Project shall have the' <br />right to have the b~se Adequate, Facilities Fee aesessed in accordance with the <br />subdivision plats approved and to devdopand construct ,the Project in. <br />accordance with theruses, density and general configuration of development, <br />described and incorporated in Section 1 under the applicable zoning, <br />subdivision, development', growth management, platting, environmental" open <br />space, transportatiQn and other landu~e plans, laws and regulations in <br />existence and effec~ive as.of the date of final subdivision approval and' the <br />terms and .condition'oof this Consent Agreement. <br /> <br />2.2.2 Reserved Leqi,lative Powers. <br /> <br />2.2.2.0.1 Future ~hangeS of Laws and Plans; compelling <br />Countervailing Public Intere.t. <br /> <br />Nothing in ehisAgr,ement shall limit the future exercise of the police power <br />of the City of conc~rd and the County in enacting zoning, subdivision, <br />development, growthi,management, platting, environmental, open. space, <br />transportation and ttherland use plans 1 policies, ordinances and regulations, <br />including ~ithout l!mitation, the enactment of impact fees and the appl~cat~on <br />the~eof, after the ~ateofthi8 Agreement. Any auchproposed.change,affecting <br />the recognized rights of the Project shall be of general application to all <br />development activity in The City of Concord or Cabarrus Co~nty. <br /> <br />2.3 ~. <br /> <br />i <br />2.3.1 Develo ment R view Fees. The Project has paid development review fees <br />for the entire projct upon submission of the application for preliminary Plat <br />approval.
