<br />1.5 Specific Conditions. The approval and development of this Project is
<br />subject to the following conditions, as agreed. upon by, the Developer and

<br />adequacy, which wi~l be adjusted annually for inflation in accordance with a

<br />2. Summary of Cabarrus County Determinations Relating 'to the

<br />The Board of: Commissioners of Cabarrus County" a,cting in its legislative
<br />capacity, has made ~he following determinations with respect to the project,
<br />including all findirgs, of fact and law as are necessary to make each of the
<br />followingdetermin~tions::
<br />2.1 County Determinations Relatinq to the Project.

<br />2.1.1 Permit Approvals; The Project has received an approval recommendation,
<br />with the conditionsl:staff recommended,' on the preliminary plat by action of the
<br />.City of Concord plapningand zoning Board taken on January 18th, 2005.

<br />2.2 Recoqnized Ri~hts In Base AdeQUate FacilitY'Fee.

<br />2.2.1.ReCOqnized,Ri~. Subject to ,Section 1~5.A, the Project shall have the'

<br />Nothing in ehisAgr,ement shall limit the future exercise of the police power
<br />of the City of conc~rd and the County in enacting zoning, subdivision,
<br />development, growthi,management, platting, environmental, open. space,
<br />transportation and ttherland use plans 1 policies, ordinances and regulations,
<br />including ~ithout l!mitation, the enactment of impact fees and the appl~cat~on
<br />the~eof, after the ~ateofthi8 Agreement. Any auchproposed.change,affecting
<br />the recognized rights of the Project shall be of general application to all
<br />development activity in The City of Concord or Cabarrus Co~nty.
