The configuration of the Project is <br />recognized as shoWn on the approved preliminary plan, copies of which are <br />available in the ~abarrus County office of Planning Services. The Project Plan <br />is subject to revlsion in accordance with the adequate facilities fees <br />provisions of the' Cabarrus County Subdivision Regulations and cabarrusCounty <br />Zoning Ordinance,: as more fully set forth herein, and any applicable provisions <br />of the provisions! of the City of Concord Unified Development Ordinance (UDO). <br />The Project Plan ,hall reflect the general location efroads and configuration <br />of lots for the Project as shown on the preliminary planj subject to revision <br />in accordance with the provisions of The City of Concord Unified Development <br />Ordinance (UDO) <br /> <br />1.5 Specific COlditiODS. The approval and 'development of this Project is <br />subject to the to lowing conditions as agreed upon by the Developer and <br />Cabarrus County S~ard of Commissioners; <br /> <br />A) paYment of $4034~OO per single family lot, to advance school <br />adequacy, which will be adjusted annually for inflation in accordance with a <br />policy establishe4 and adopted from time to time by the Cabarrus County Board <br />of Commissioners. i,Total payment for the current approved project is $399366.00. <br /> <br />5l Payment ieto be made at the issuance of Building permitting, or <br />may be paid in acqordance with a written payment plan specifically approved by <br />Cabarrus County, a copy of which is attached hereto as Exhibit Band <br />incorporated herein by reference; <br /> <br />2. Summary of Cabarrus County Determinations Relating to the <br />Project. <br /> <br />The Board of Commissioners of CabarrusCounty, acting in its legislative <br />capacity, has madefthe following determinations with respect to the project, <br />including all find~ngs of fact and law as areneceasary to make each of the <br />following determin.tions; <br /> <br />2.1 <br /> <br />County Determinations Relatinq to the Proiect. <br /> <br />2.1.1 <br />with <br />City <br /> <br />Permit A~Droval8. The project has received an approval recommendation, <br />the condition, staff recommended,on the preliminary plat by action of the <br />of Concord PI_nning and Zoning Board taken on March 15th, 200S. <br /> <br />2.2 <br /> <br />Recoqnized RiQhts In Base AdeQUate Facility Fee. <br /> <br />2.2.1 Reco nized R hte. Subject to Section 1.S.A, the project shall have the <br />right to have the ase Adequate Facilities Fee assessed in accordance with the <br />subdivision plats ,pproved and .to develop and construct the Project in <br />accordance with th. uses, density and general configuration of development <br />described and incotporated in Section 1 under the applicable zoning, <br />subdivision, develQpment, growth management, platting, environmental, open <br />space, transportatton and other land, use plans,laws and regulations in . <br />existence andeffeqtive as of the date of final subdivision approval and the <br />.terms and conditio~s of this Consent Agreement. <br /> <br />2.2.2 Reserved Leq~slative Powers. <br /> <br />Future iChanges of Laws and Plans; Compelling <br />Counte~ailing Public Interest. <br /> <br />Nothing in this Ag~eement ahall limit the future exercise of the police power <br />of the City ofconqord and the County in enacting zoning, subdivision, <br />development, growt~ management, platting, environmental, open space, <br />transportation and pther land use plane, policies, ordinances and regulation_, <br />inClUding without l~mitaeion, the enactment of impact fees and the application <br />thereOf, after the~ate of this Agreement. Any such proposed change affecting <br />the recognized righ~s of the Project shall be of general application to all <br />development activity in The City of Concord or Cabarrue County. <br /> <br />2.2.2.0.1 <br /> <br />2.3 EM!. <br /> <br />2.3.1 Development R~view Fees. The Project ha_ paid development review fees <br />for the entire proj~ct upon submission of the application for Preliminary 'Plat <br />approval.
