<br />units per gross a~re of the Property. No multi-tamily units are approved for <br />tho Project. <br /> <br />1.4 contiquratifn of Development. The configuration of the Project is <br />recognized as shown on the approved preliminary plan, copies of which are <br />available in the ~abarrus County office of Planning S~rvice.. The Proj~ct Plan <br />is subject to revtsion in accordance with the adequate facilities fees <br />provisions of the Cabarrus County Subdivision Regulations and Cabarrus County <br />Zoning ordinance, 'as more fully set forth herein, and any applicable provisions <br />of tho provisions of the City of Concord UnifiedCevelopment Ordinance (UDO). <br />The Project Plan shall reflect the general location of roads and configuration <br />of lots for the ptoject as shown on the preliminary plan; subject to revision <br />in accordance witb the provisions of The City of Concord Unified Development <br />Ordinance (UDO) <br /> <br />1.5 Specific Coqditione. The approval and development of this project is <br />subject to the following conditions as agreed upon by the Developer and <br />Cabarrus County B~ard of Commissioners: <br /> <br />A) pay,ment of $1331.00 per single family lot, to advance school <br />adequacy, which will be adjusted annually for inflation in accordance with a <br />policy establisheq and adopted from time to time by the Cabarrus County Board <br />of Commissioners. ,Total payment for the current approved Project is $69212.00. <br /> <br />B) Payment is to be made at the issuance of Building Permitting, or <br />may be paid in accordance with a written payment plan specifically approved by <br />Cabarrus County, a copy of which is attached hereto as Exhibit Band <br />incorporated herein by reference. <br /> <br />:2. Summary of ,C4barrus County Determinations Relating to the <br />Project. <br /> <br />The Board of Commissioners of Cabarrus County, acting in its legislative <br />capacity, haa made; the following determinations wieh respect to the project, <br />including allfindingsot fact and law as are necessary to make each of the <br />following determinations: <br /> <br />2.1 County Determinations Relatinq to the Pro1ect. <br />2.1.1 Permit A~protals. The project has' received an approval recommendation, <br />with the condition, staff recommended, on the preliminary plat by action.of the <br />City of ConeordPI.nning and zoning Board taken on March 15th, 200~. <br />2.2 Recoqnized RfqhtslnBase Adeauate Pacility Fee. <br />2.2.1 Recognized R+qhts. Subject ,eo Section l.S.A, the project shall have the <br />right to have the Uase Adequate Pacilities Fee assessed in accordance with the <br />subdivision plats 4Pproved and to develop and construct the project in <br />accordance with the uses, density and general configuration of development <br />described and inco:;porated in Section 1 under 'the applicable zoning, <br />subdivision" develqpment,. growth management, platting, environmental, open <br />space, transportat1on and other land use plans, laws and regulations in <br />existence and,effeqtive as of the date of final subdiviaion approval and the <br />terms and conditio~s of this Consent Agreement. <br /> <br />1-- d.-5 <br /> <br /> <br />2.2.2 Reserved Leq~.lative Powers. <br /> <br />2.2.2.0.1 Future ~h.nge8 of Laws and Plansr Compelling <br />Counte=vailing Public Interest. <br /> <br />Nothing in this Agreement shall limit the future exerciae of the police power <br />of the City of Condordand the County in enacting zoning, subdivision, <br />development, growth management, platting, environmental, open space, <br />transportation and ;other land use plans, policie.,. ordinance. and regulations, <br />including without limitation, the enactment of impact fees ,and the application <br />thereof, after the date of this Agreement. Any such proposed change affecting <br />the recognized rig~t8 of the Project shall be of general application to all <br />development activity in The City of Concord or CabarrusCounty. <br /> <br />2.3 ~. <br /> <br />2.3.1 Develo ment R.view Fees. The project has paid development review fees <br />for the entire proj ct upon submission of the' a.pplication for Preliminary Plat <br />approval. No furth.r development review fees for a preliminary Plat approval <br />shall be charged by:Cabarrus County to the Project. <br />
