<br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br />ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as follows: <br /> <br /> <br />. Add the following text to Chapter Four - Overlay Districts: <br /> <br />Part VII. MANUFACTURED HOME OVERLAY (MHOD) <br />DISTRICTS. <br /> <br />Section 4-43. PURPOSE. <br /> <br />The purpose of this Section is to provide sufficient land area for the provision of manufactured housing in order to <br />implement NCGS ~ 160A-383.1 and to provide affordable housing opportunities for low and moderate income <br />persons. A manufactured home is defmed as structure, used or intended to be used as a Dwelling Unit, transportable <br />in one or more sections, which in the traveling mode is eight body feet or more in width, or 40 body feet or more in <br />length, or, when erected on site, is 320 or more square feet; and which is built on a permanent chassis and designed <br />to be used as a dwelling, with or without permanent foundation when connected to the required utilities, including <br />the plumbing, heating, air conditioning and electrical systems contained therein. "Manufactured home" includes any <br />structure that meets all of the requirements of this subsection except the size requirements and with respect to which <br />the manufacturer voluntarily files a certification required by the Secretary of the United States Department of <br />Housing and Urban Development and complies with the standards established under the National Manufactured <br />Housing Construction and Safety Standards Act of 1974, 42 U.S.C. ~5401, et seq. (Source: The Uniform Standards <br />Code for Manufactured Homes Act," NCGS ~ 143-145). For purposes of this Ordinance, a "manufactured home" <br />does not include a structure which otherwise complies with this subsection, but which was built prior to June 15, <br />1976, which units shall be classified as "mobile homes." <br /> <br />Section 4-44. MODULAR HOMES EXEMPTED. <br /> <br />Manufactured (or Modular) Housing Constructed to meet the N.C. State Building Code shall be exempt from the <br />restrictions of this Part VII and shall be permitted in any Single-family detached dwelling zoning district subject to <br />any other provisions of this Ordinance. <br /> <br />Section 4-45. ESTABLISHMENT. <br /> <br />This Section establishes three (3) Manufactured Home Overlay Districts in order to provide flexibility with regard to <br />various manufactured home products: <br /> <br />MH-I <br />MH-2 <br />MHP <br /> <br />Section 4-46. CLASSIFICATION OF MANUFACTURED HOMES AND RECREATIONAL VEIDCLES.. <br /> <br />The following classification system is hereby adopted for purposes of this Section: <br /> <br />MANUFACTURED HOME _ TYPE I. A single-section manufactured home less than seventeen (17) feet in width. <br /> <br />MANUFACTURED HOME - TYPE II. A multi-section manufactured home greater than or equal to seventeen (17) <br />feet in width. <br /> <br />The width of a manufactured home shall be determined by mean width when all sections are in a fmal assembly <br /> <br />Cr./( <br />
