<br />5. Direction of Service <br />The maintenance and repairs of school park facilities shall be under the control <br />and supervision of the Director of Facilities and Operations of the Cabarrus <br />County Schools. The Director of Facilities and Operations will provide Cabarrus <br />County Parks and Recreation Department with a written report covering all <br />maintenance/repairs completed once per quarter. <br /> <br />6. Funds <br />Implementation of this agreement is contingent upon the Cabarrus County Board <br />of Commissioners allocating funds in the Fiscal Year 2005-2006. This fund once <br />approved will be utilized exclusively for maintenance and repairs to school park <br />facilities on Cabarrus County Schools and Kannapolis City School sites. <br />Cabarrus County Schools Director of Finance will maintain this fund and a report <br />will be issued quarterly showing all disbursements. Cabarrus County Parks & <br />Recreation will be provided the account balance and other details regarding this <br />account at any time upon request. In the event that the estimated cost of actual <br />repairs for a requested job exceeds the approved fund's current balance, the <br />Director of Facilities will notify Cabarrus County Parks and Recreation <br />Department so that they may seek additional funding before future repairs can be <br />made. <br /> <br />7. Maintenance/Reoairs Facilities Imorovements Onlv <br />The intent of this agreement is for general maintenance and repairs of current <br />school/park sites only. No expansions or total replacement of any Capitol <br />Improvements will occur without written agreement by both parties prior to work <br />performed. In some instances, it may be prudent to order the replacement of a <br />facility element, instead of general maintenance or repairs; therefore, the two <br />parties may elect to order total replacement of a facility item; examples new <br />HVAC equipment unit, fencing, Roofing etc. <br /> <br />8. Athletic Game Preoaration <br />All athletic game and initial field preparation, installing home plates, marking <br />dust/paint, pitching rubbers, bases, and infield dirt will be performed by others <br />(volunteer athletic association or City/County Parks and Recreation <br />Departments) and not included within this contract agreement. <br /> <br />9. Disoutes, Termination, Severabilitv. Governinq Law <br />The same guidelines as set forth in sections 8, 9, 10, 11 of the original <br />"Maintenance and Repair Agreement" shall apply to this amendment. <br /> <br />IN WITNESS WHEREOF, the Cabarrus County Board of Education, the Kannapolis City <br />Board of Education and the Cabarrus County Board of Commissioners tlave executed <br />this Addendum as of the dates set forth below. <br /> <br />~l~ <br />3 <br />
