<br />5. Direction of Service <br />The maintenance and repairs of school park facilities shall be under the control and <br />supervision of the Director of Facilities and Operations of the Cabarrus County <br />Schools. The Director of Facilities and Operations will provide Cabarrus County Parks <br />and Recreation Department with a written report covering all maintenance/repairs <br />completed once per quarter. <br /> <br />6. Funds <br />Implementation of this agreement is contingent upon the Cabarrus County Board of <br />Commissioners allocating funds in the Fiscal Year 2005-2006. This fund once <br />approved will be utilized exclusively for maintenance and repairs to school park <br />facilities on CabarrusCounty Schools and Kannapolis City School sites. Cabarrus <br />County Schools Director of Finance will maintain this fund and a report will be issued <br />quarterly showing all oisbursements. Cabarrus County Parks & Recreation will be <br />provided the account balance and other details regarding this account at any time <br />upon request. If the cost of repairs on any individual work order exceeds $2000.00 the <br />Director of Facilities will notify the Director of Parks & Recreation. Once the remaining <br />budget balance reaches $5,000.00 or less, the Director of Facilities will advise the <br />Director of Parks & Recreation so that additional funds can be requested if needed <br />prior to the end of the contract year. <br /> <br />7. Maintenance/Reoairs Fllcilities Improvements Onlv <br />The intent of this agreement is for general maintenance and repairs of current <br />school/park sites only; No expansions or total replacement of any Capitol <br />Improvements will occur without written agreement by both parties prior to work <br />performed. I n some instances, it may be prudent to order the replacement of a facility <br />element, instead of general maintenance or repairs; therefore, the two parties may <br />elect to order total replacement of a facility item; examples new HV AC equipment unit, <br />fencing, Roofing etc. <br /> <br />8. Athletic Game Preparation <br />All athletic game and initial field preparation, installing homeplates, marking dust/paint, <br />pitching rubbers, bases, and infield dirt will be performed by others (volunteer athletic <br />association or City/County Parks and Recreation Departments) and not included within <br />this contract agreement. <br /> <br />9. Disputes. Termination. $everabilitv. Goveming Law <br />The same guidelines as set forth in sections 8, 9, 10, 11 of the original "Maintenance <br />and Repair Agreement" shall apply to this amendment. <br /> <br />r~ I~' ~ <br /> <br />13 <br />
