<br />AN ORDINANCE AMENDING THE CABARRUS <br />COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is <br />hereby amended as follows. <br /> <br />1. By modifying Chapter Four, Part II: River/Stream Overlay <br />(RSOZ) Zone as follows: <br /> <br />PART II. RIVER/STREAM OVERLAY (RSOZ) ZONE <br /> <br />Section 4-8. River/Stream overlay zone. <br /> <br />All rivers or streams shown on USGS Quadrangle Maps as a solid blue line (perennial <br />streams) or as a dotted blue line (intermittent streams) shall be subject to these requirements. <br /> <br />Section 4-9. Intention. <br /> <br />A strip of land adjacent to a stream or river retained in its natural vegetation or <br />revegetated or reforested by appropriate perennial vegetation to avoid erosion problems wHI <br />reduce the velocity of overland flow, trap sediment and soH eroded from cropland or land being <br />developed, and limit other pollutants from entering the waterway. <br /> <br />Section 4-10. Effect upon bona fide farms. <br /> <br />While North Carolina law exempts bona fide farms from local zoning reguiations, the <br />County strongly encourages the use of best management practices in farming. A stream buffer is <br />one of these practices and is therefore consistent with North Carolina Sediment Control Law and <br />thus is a 75% reimbursable North Carolina Agricultural Cost - Share Program. This program Is <br />administered through the Cabarrus SoH and Water District. Therefore, the following text shall <br />apply to all development (farming is not considered development) or changing of conditions (e.g., <br />timbering) adjacent to a perennial stream as defined below. <br /> <br />Section 4"11. Requirements of the RSOZ. <br /> <br />1. A 50 foot stream buffer shall be established on both sides of all perennial streams indicated 6ft , <br />~ a solid blue line on the USGS Quadrangle maps, and a 35 foot stream buffer on both sides of all <br />intermittent streams indicated bv a dotted blue line on the USGS Ouadranale maps. The applicant <br />mav substitute a detailed survev to field verify the location of perennial and intermittent streams <br />on the subiect propertv and within 100 feet of the boundarY of the subiect propertv for the <br />delineation on the USGS Ouadranale maps. All designated floodways and flood fringe areas as <br />defined by the Federal Emergency Management Agency (FEMA) are also subject to these <br />restrictions. No development, including soil disturbing activities, shall occur within this buffer strip <br />except as listed in 48 below. <br /> <br />-1 - <br />/1::-1 (0.) <br />
