The Applicant shall comply with the terms of Title II and Title III, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646), 94 Stat. 1894 (1970), and the applicable regulations and procedures implementing such Act for all real property acquisition and where applicable shall assure that the Act has been complied with for property to be developed with assistance under the project . agreement. . I. If any tract or parcel of, or interest in, real property subject to being purchased under the provisions of this agreement, but not identified herein, is found by the State and the Director for any reason not to be suitable for federal assistance, all obligations of the State and the United States hereunder shall cease as to such parcel, tract, or interest. J. Proiect Administration 1. The Applicant shall promptly submit such reports as the State and the Director may request. 2.. Property and facilities acquired or developed pursuant to this agreement shall . be available for inspection by the State and the Director upon request. 3. The Applicant shall use any iunds received by way of advance payment from the United States under the terms of this agreement solely for the project state herein described. 4. Interest earned on funds granted pursuant to this agreement shall not be available for expenditure by the Applicant, but shall be disposed of according to instructions .issued by the State and the Director. . 5. Because one of the basic objectives of the Land and Water Conservation Fund Act is to enhance and increase the nation's outdoor recreation resources, it is the intent of the parties hereto that recipients of assistance will use monies granted hereunder for the purposes of this program, and that assistance granted from the Fund will result in a net increase, commensurate at least with the federal cost-share, in a participant's outdoor recreation. It is intended by both parties hereto that assistance from the Fund will be added to, rather than replace or be substitutes for, local outdoor recreation funds. V. REIMBURSEMENT OF PROJECT COSTS A. The Applicant agrees to maintain and make available at proper times to the State and to the Director accurate records of all expenditures for costs applicable to this agreement, and to submit properly certified billings for such costs in forms prescribed by the State and supported by detailed data sheets that will facilitate the audit of the Applicant's financial records. Complete accounting records, including original invoices, payrolls, contracts, or other documents cieatly showing the nature and property of all costs incurred under this agreement, shall be retained by the Applicant for a period of three years following project completion; except the records shall be retained beyond the three-year period if audit findings have not been resolved.
