G.S. 58~79-1 et <br /> <br />Sec. 34-55, Issuance of ~otice of violation by ~ire I~nspectore, <br />i <br /> <br />(a) Fire I~nspectors areiempowered to issue notices of violation when such <br />F~ire I~nspectors have r~asonable cause to believe that any person has violated <br />any provision of the Int~rnational Fire Prevention Code. Amendments. <br /> <br />(b) The service of order$ or notices for the correction of violations of the <br />code shall be made upon ~he owner, occupant or other person responsible for the <br />conditions, either by pe~sonally delivering a copy of same to such person or by <br />delivering the same to a4d leaving it with any person in charge of the premises <br />or by sending a copy of ~he order or notices by certified or registered mail to <br />the owner's last known address. <br /> <br />(c) When buildings or th~ir premises are occupied by one other than the owner <br />Under a lease or agreeme~t, the orders or notices issued to correct violations <br />of the code shall apply tio the occupant thereof; provided that where the order <br />or notices require the m~king of additions to or changes in the premises <br />themselves which may becdme part of the real property of the owner, then in <br />such cases, the orders o~ notices shall also be issued to the owner of the <br />premises or real propert1. Failure to deliver an order or notice to the owner, <br />if other than the occupaqt, shall not invalidate such order or notices. <br /> <br />(d) The notice of violat~on shall specify the penalty to be imposed on the <br />violator and shall direct; the violator to aJilJilear eefsre she puelis gaEesy <br />ger.-ises submit the penaity payment to the J!lmergency Management Department <br />aeJilarSmeRs within 15 bus~ness days to pay the penalty. The penalty imposed <br />shall be $50.00 for violations of the fire prevention code. However, violations <br />of "Exit Obstruction" sha,ll be deemed "Life Safety" violations which shall <br />subject the offender to a penalty of $250.00~ and "Open BurningH violations <br />shall be subject to a pe~alty of $100.00. ' <br />I, <br />(e) The notice of violat~on may specify a period during which the violator must <br />correct the violation. If the violation is not corrected within the specified <br />time, the violator shall be guilty of a new and separate offense. <br /> <br />(f) If the violator does ,not pay the penalty within the 15 business days after <br />the issuance of the notiqe of violatiOn, a delinquency charge of $10.00 shall, <br />be added to the amount s~~cified in the notice of violation and notice of the <br />delinquency charge shall'be mailed to the violator. The delinquency notice <br />shall also inform the vioUator that a criminal summons will be issued against <br />I <br />him if the specified pen~Qty and the delinquency charge are not paid within <br />five business days after ~he date of the delinquency notice. <br />I <br /> <br />(g) If the penalty and d~linquency charges are not paid ,within the time <br />allowed, the Cabarrus coupty PaeLls Safet)' gerviees J!lmergency Management <br />Department may have a cri~inal summons issued'against the violator of the <br />International Fire Prevention Code.N. C. Amendments.
