<br />Ethics in Public Contracting: The County shall incorporate by reference but shall not be <br />limited to the provisions of law contained in the North Carolina General Statutes. The bidder <br />certifies that it's bid was made without collusion or fraud; that it has not offered or received <br />any kickbacks or inducements from any other bidder, supplier, manufacturer, or <br />subcontractor in connection with the bid; and that it has not conferred on any public <br />employee having official responsibility for this procurement transaction any payment, loan, <br />subscription, advance, deposit of money, services or anything of more than nominal value. <br /> <br />Failure to Deliver: In the event of failure of the Contractor to deliver services in <br />accordance with the contract terms and conditions, the County, after due oral or written <br />notice, and after an insufficient and unacceptable response from the Contractor in the <br />County's sole discretion, the County may procure the services from other sources and hold <br />the Contractor responsible for any resulting additional purchase and administrative costs. <br />This remedy shall be in addition to any other remedies that the County may have. <br /> <br />Immigration Reform and Control Act of 1986: The Contractor certifies that it does not <br />and will not during the performance of this contract employ illegal alien workers or <br />otherwise violate the provisions of the Federal Immigration Reform and Control Act of 1986. <br /> <br />Indemnification: The Contractor covenants to save, defend, hold harmless and indemnify <br />the County and all of its officers, departments, agencies, agents and employees from and <br />against all claims, loss, damage, injury, fines, penalties and cost - including court costs and <br />attorney's fees, charges, liability and exposure, however caused - resulting from, arising out <br />of, or in any way connected with the Contractor's negligent performance or non-performance <br />of the terms of the contract. <br /> <br />Insurance: <br /> <br />Coverage . <br /> <br />Minimum Limits <br /> <br />Workers' Compensation <br /> <br />Employers' Liability <br />General Liability <br />Automobile Liability <br /> <br />$ 500,000 minimum; Statutory Limits Preferred <br />$ 500,000 <br />$1,000,000 per occurrence /$2,000,000 aggregate <br />$1,000,000 <br /> <br />Professional Liability <br /> <br />$1,000,000 per occurrence/$2,000,000 aggregate <br /> <br />The County shall be named as an additional insured and it is required that coverage be placed <br />with U A" rated insurance companies acceptable to the County. Statement should read <br />"Cabarrus County is to be added as an additional insured as evidenced by an endorsement <br /> <br />G..'l <br />
