The appeal to Superior Court must be filed within thirty (30) <br />days of the filing by the Secretary of the Commission of the decision in the office of <br />the Zoning Administrator or the delivery by the Zoning Administrator of the <br />notice required in Chapter Thirteen, whichever is later. <br /> <br />Section 12-26. Duties of the Board of County Commissioners. <br /> <br />Because of the quasi-judicial nature of the actions of the Cabarrus County <br />Planning and Zoning Commission when acting as a board of adjustment, state law <br />does not permit appeals of actions of the board of adjustment to the Board of <br />County Commissioners. The role of the Board of County Commissioners is <br />legislative in nature and confined to the adoption, amendment, and/or rescission <br />of this Ordinance. <br /> <br />Part III. Enforcement. <br /> <br />Section 12-27. Violations. <br /> <br />In addition to any other remedies cited in this section for the enforcement <br />of the provisions of this Ordinance, the regulations and standards herein may be <br />enforced through the issuance of citations by the Zoning Office in accordance with <br />G.S.153A-123. These citations are in the form of a civil penalty. The County may <br />recover this penalty in a civil action in the nature of a debt if the offender does not <br />pay the penalty within 72 hours after being cited for a violation.
