<br />3. That the project is not complete and another date for a [mal inspection will be <br />established, <br /> <br />Z. Within fourteen (14) days of acceptance per Paragraph B(1) above or within fourteen <br />(14) days after completion of punch list per Paragraph B(2) above, the Architect shall certify the <br />Work and issue applicable certificate( s) of compliance. <br /> <br />AA, Any discrepancies listed or discovered after the date of [mal inspection and <br />acceptance under Paragraphs B(1) or B(2) ofthis Article 23 shall be handled in accordance with <br />Article 38, Guarantee. <br /> <br />BB. The date of acceptance will establish the following: <br /> <br />1. The beginning of guarantees and warranties period. <br /> <br />2. The date on which the contractor's insurance coverage for public liability, <br />property damage and builder's risk may be terminated. <br /> <br />3. The termination date of utility cost to the contractor, <br /> <br />ARTICLE 24 - CORRECTION OF WORK BEFORE FINAL PAYMENT <br /> <br />CC. Any Work, materials, fabricated items or other parts of the Work which have been <br />condemned or declared not in accordance with the contract by the Architect shall be promptly <br />removed from the Work site by the CM, and shall be immediately be replaced by new Work in <br />accordance with the contract at no additional cost to the Owner. Work or property of the Owner, <br />damaged or destroyed by virtue of such faulty Work, shall be made good at the expense of the CM. <br /> <br />DD. Correction of condemned Work described above shall commence within twenty-four <br />(24) hours after receipt of notice from the Architect, and shall make satisfactory progress until <br />completed. <br /> <br />EE. Should the CM fail to proceed with the required corrections, then the Owner may <br />complete the Work in accordance with the provisions of Article 3B of the Contract for Construction <br />Manager at Risk. <br /> <br />ARTICLE 25 - CORRECTION OF WORK AFTER FINAL PAYMENT <br /> <br />Neither the final certificate, final payment, occupancy of the premises by the Owner, nor any <br />provision of the contract, nor any other act or instrument of the Owner, nor the Architect, shall <br />relieve the CM from responsibility for negligence, or faulty material or Workmanship, or failure to <br />comply with the drawings and specifications. 1t shall correct or make good any defects due thereto <br /> <br />EE:00049966. <br /> <br />-17- <br />F-4- <br />
