<br />of the insurance coverages are required to remain in full force after fmal <br />payment and are reasonably available, an additional certificate evidencing <br />continuing of such coverage shall be submitted with the fmal Application for <br />Payment. <br /> <br />ARTICLE 31 - PERFORMANCE BOND AND PAYMENT BOND <br /> <br />EEE. The CM shall furnish a performance bond and payment bond executed by a surety <br />company authorized to do business in North Carolina. The bonds shall be in the full contract <br />amount, which shall be in the amount of the GMP for the entire project. Bonds shall be executed on <br />the AIA document A-312 Form. <br /> <br />FFF. All bonds shall be countersigned by an authorized agent of the bonding company who <br />is licensed to do business in North Carolina. <br /> <br />ARTICLE 32 - AFFIDAVIT OF CONSTRUCTION MANAGER <br /> <br />The final payment of retained amount due the CM on account of the contract shall not <br />become due until the CM has furnished to the Owner through the Architect an affidavit signed, <br />sworn and notarized to the effect that all payments for materials, services or subcontracted Work to <br />principal trade and specialty contractors in connection with his contract have been satisfied, and that <br />no claims or liens exist against the CM in connection with this contract. In the event that the CM <br />cannot obtain similar affidavits from subcontractors to protect the CM and the Owner from possible <br />liens or claims against the subcontractor, the CM shall state in his affidavit that no claims or liens <br />exist against any subcontractor to the best of its (the CM' s) knowledge, and if any appear afterward, <br />the CM shall save the Owner harmless. <br /> <br />ARTICLE 33 - ASSIGNMENTS <br /> <br />The CM shall not assign any portion ofthis contract nor subcontract inits entirety. Except as <br />may be required under terms of the performance bond or payment bond, no funds or sums of money <br />due or to become due the CM under the contract may be assigned. <br /> <br />ARTICLE 34 - USE OF PREMISES <br /> <br />GGG, The CM shall confme his apparatus, the storage of materials and the operations of his <br />Workmen to limits indicated by law, ordinances, permits or directions of the Architect and it shall <br />not exceed those established limits in its operations. <br /> <br />HHH, The CM shall not load or permit any part ofthe structure to be loaded with a weight <br />that will endanger its safety. <br /> <br />EE:00049966. <br /> <br />-25- <br /> <br />F- if- <br />
