<br />. <br /> <br />ARTICLE 42 - EQUAL OPPORTUNITY CLAUSE <br /> <br />The non-discrimination clause contained in Section 202 (Federal) Executive Order 11246, as <br />amended by Executive Order 11375, relative to equal employment opportunity for all persons <br />without regard to race, color, religion, sex or national origin, and the implementing rules and <br />regulations prescribed by the secretary of Labor, are incorporated herein. <br /> <br />ARTICLE 43 - EMPLOYMENT OF THE HANDICAPPED <br /> <br />The CM agrees not to discriminate against any employee or applicant for employment <br />because of physical or mental handicap in regard to any position for which the employee or applicant <br />is qualified. The CM agrees to take affirmative action to employ, advance in employment and <br />otherwise treat qualified handicapped individuals without discrimination based upon their physical or <br />mental handicap in all employment practices. <br /> <br />ARTICLE 44 - ASBESTOS-CONTAINING MATERIALS (ACMl <br /> <br />The State of North Carolina has attempted to address all asbestos-containing materials that <br />are to be disturbed in the project. However, there may be other asbestos-containing materials in the <br />Work areas that are not to be disturbed and do not create an exposure hazard. Contractors are <br />reminded of the requirements of instructions under General Conditions of the Contract, titled <br />Examination of Conditions. Statute 130A, Article 19, amended August 3, 1989, established the <br />Asbestos Hazard Management Program that controls asbestos abatement in North Carolina. The <br />latest edition of Guideline Criteria for Asbestos Abatement from the State Construction Office is to <br />be incorporated in all asbestos abatement projects for the Capital hnprovement Program. <br /> <br />ARTICLE 45 - MINORITY BUSINESS PARTICIPATION <br /> <br />N.C.Gen.Stat. S 143-128.2 establishes a ten percent (10%) goal for participationby minority <br />businesses in total value ofW ork for each State building project and requires documentation of good <br />faith efforts for meeting that goal. The document, Guidelines for Recruitment and Selection of <br />Minority Businesses for Participation in State Construction Contracts including Affidavits and <br />Appendix E are hereby incorporated into and made a part of this contract. <br /> <br />ARTICLE 46 - ENTIRE AGREEMENT <br /> <br />. The Contract Documents constitute the entire agreement between the parties hereto with <br />regard to the subject matter contained in each such component of the Contract Documents. No <br />course of prior dealings between the parties and no usage of trade shall be relevant or admissible to <br />supplement, explain or vary any of the terms set forth herein.
