Mr. Jonathan Marshall
Page Two

is in extremely poor condition and is barely passable. Generally, a four wheel drive
vehicle is necessary to traverse same. The "f~/rm road" is not in a condition for
emergency vehicles, particularly ambulances and/or fire trucks, to traverse. In many
instances, the adjoining plowed or cropped fields are in better condition that the "farm
road."

It ~s our understanding that the Commissioners "authority" to name the "farm road" is
N.C.G.S. § 136-67. Neighborhood public roads. Same provides that "all other roads or
street or portions of road or streets whatsoever outside of the boundaries of an
incorporated city of town in the State which serve a public area ...... "are "declared to be
neighborhood public roads and shall be subject to all the provisions of G.S. 136-68, 136-
69, and 136-70"." The Furr Farm has been voluntarily annexed into the City of Locust.
Thereby we contend the naming of that portion of "farm road" located on the Furr Farm
is outside the jurisdiction of the Cabarrus County Commissioners.

The Furr Heirs reserve the right to (i) prosecute any and all persons who trespass on the
Furr Farm, including for the use of the "farm road" for ingress and egress purposes to
and from N.C. Highway 200; and (ii) institute legal proceeds to obtain compensation for
any loss or damage suffered due to the formal naming of said "farm road".

Please contact me if you have any questions concerning our position. Thanking you in advance
for your attention to this matter.

Very truly yours,

Mary Elizabeth Stewart

MES/
CCi

Dr. Carl A. Furr, Jr.
Mr. Guilford E. Furr
Mr. Fletcher Hartsell, County Attorney
