The "f~/rm road" is not in a condition for <br />emergency vehicles, particularly ambulances and/or fire trucks, to traverse. In many <br />instances, the adjoining plowed or cropped fields are in better condition that the "farm <br />road." <br /> <br />It ~s our understanding that the Commissioners "authority" to name the "farm road" is <br />N.C.G.S. § 136-67. Neighborhood public roads. Same provides that "all other roads or <br />street or portions of road or streets whatsoever outside of the boundaries of an <br />incorporated city of town in the State which serve a public area ...... "are "declared to be <br />neighborhood public roads and shall be subject to all the provisions of G.S. 136-68, 136- <br />69, and 136-70"." The Furr Farm has been voluntarily annexed into the City of Locust. <br />Thereby we contend the naming of that portion of "farm road" located on the Furr Farm <br />is outside the jurisdiction of the Cabarrus County Commissioners. <br /> <br />The Furr Heirs reserve the right to (i) prosecute any and all persons who trespass on the <br />Furr Farm, including for the use of the "farm road" for ingress and egress purposes to <br />and from N.C. Highway 200; and (ii) institute legal proceeds to obtain compensation for <br />any loss or damage suffered due to the formal naming of said "farm road". <br /> <br /> Please contact me if you have any questions concerning our position.
