Legislature to repeal GS 104-7 B__eaufort County_ Commissioner_s Resolution: For Senator Marc Basnight to take actio~ to request a special session of the Legislature to repel NCGS 104-7 enacted during 1907. WHEREAS: The State of North Carolina unilaterally has granted "exclusivity of law" to the Federal Government for all facilities acquired "by purchase, condemnation, or otherwise, of any land in the State required for the sites for customhouses, courthouses, post offices, arsenals, or other public buildings whatever, or for any other purposes of the government". WHEREAS: The Constitution of the United States requires that the Federal Government can obtain "exclusivity" only by grant of a State, WHEREAS: The present General Statute grants Exclustvity to all Federal entities without the requirement for review by the State, WHEREAS: Property rights are granted by the Federal and State Governments, these Rights are sacred and inalienable from and to the citizens of North Carolina, WHEREAS: North Carolina General Statute 104-7 enacted during 1907 has served its purpose. WHEREAS: The complexity and diversity of this modem Federal Government is such that not all facilities proposed by the Federal Government are beneficial to some or all of the citizens of the State of North Carolina, be it resolved this fifth day of January 2004, That Senator Marc Basnight support and present to the Governor of the State of North Carolina the necess3.ry demands and petitions for a special session of the Legislature to be called immediately to consider repealing NCGS 104-7.
