SECTION VIII: TERMINATION <br /> <br />This Contract may be terminated, in whole or in part: <br /> <br />A. At the expiration of the contract terms as herein defined; or <br />B. Upon mutual consent of both parties or thirty (30) days after one oft. he <br /> contracting parties gives notice of the termination; or <br />C. Upon action by legislative, regulatory or judicial authority preempting, voiding or <br /> preventing implementation or continuance of this Contract; or <br />D. By the County in event that funds are no longer available for the purchase of <br /> services. <br />E. Notification of termination of contract by either side shall be given 30 days prior <br /> to said termination. <br /> <br />SECTION IX: INDEPENDENT CONTRACTORS <br /> <br />The officers, employees, subcontractors, agents and all personnel of the provider are the <br />officers, employees, subcontractors, and agents of the Provider and are not officers, <br />employees, subcontractors or agents of the County. The Provider is an independent <br />contractor of the County. The Provider further agrees that it and its officers, employees, <br />subcontractors and agents shall obey all state and federal statutes, rules and regulations <br />and are subject to all funding and administrative conditions or hereafter applicable to the <br />Criminal Justice Partnership Program. <br /> <br />SECTION X: CONTRACT ADMINISTRATOR <br /> <br />Cabarms County shall serve as administrator of this contract. The contract administrator <br />shall be responsible for monitoring the Provider's performance; reviewing all invoices <br />submitted by the Provider for treatment services delivered to clients prior to the <br />submission to the County; reviewing all referrals made by the Provider to outside <br />treatment services, and reviewing all outcome data provided by the Provider. Copies of <br />all above data will also be forwarded to Ronda W. Powell, Cabarrus County Division of <br />Community Corrections. <br /> <br />SECTION XI: CONFIDENTIALITY <br /> <br />The Provider shall disclose only to the County, the Contract Administrator, and the NC <br />State Criminal Justice Partnership Program any reproduction; description, or information <br />concerning the work produced as a result of this project or task unless written permission <br />is otherwise granted by the County. Further, in connection with the client's records and <br />all information contained therein, including client identifying information, the Prowder <br />agrees as follows: <br /> <br />Page 7 of 9 <br /> <br /> <br />
