RESOLUTION AUTHORIZING <br /> <br />BRADFORD ROAD PROPERTY EXCHANGE <br /> <br />Resolution No 2004-__ <br /> <br />WHEREAS, Cabarrus County owns property offBradford Road that serves as a buffer area for Lake Howell, and; <br /> <br />WHEREAS, Charles Bradford owns property off Bradford Road adjacent to that land owned by Cabarrus County, <br />and; <br /> <br />WHEREAS, Mr. Bradford has agreed to an equal exchange of approximately .84 acre (County Parcel Identification <br />Number 4682-83-4239) for approyamately .84 acre of property (Lake Howell Buffer Area) with Cabarrus County, <br />and; <br /> <br />WHEREAS, the property owned by Mr. Bradford and that owned by Cabarrus County are of equal monetary value, <br />and; <br /> <br />WHEREAS, the property that Mr. Bradford would transfer to Cabarrus County is of equal or greater value as a <br />buffer for Lake Howell; and <br /> <br />WHEREAS, the County may exchange real property belonging to the County for other real property by private <br />negotiation if the County receives full and fair consideration m exchange; and <br /> <br />WHEREAS, a notice of the Board's intent to consider a resolution authorizing the Exchange was published in THE <br />INDEPENDENT TRIBUNE on February 6 and February 13, 2004; and <br /> <br />WHEREAS, no one has objected to the Exchange in advance of the regular meeting of the Board of Commissioners <br />scheduled for 6:30 p.m. on February 16, 2004. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Cabarrus County Board of Commissioners agrees to the <br />transfer of County property to Charles Bradford in exchange for an equal amount of property and authorizes the <br />County Manager to sign all transfer documents related to this exchange of property. <br /> <br />Adopted this the day ofl~ebruary, 2004. <br /> <br />ATTEST: <br /> <br />Robert M.
