DRAFT <br /> <br />February 16, 2004 Page 370 <br /> <br /> Pam Dubois, Finance Director, reported that the amount exceeds the $400 00 <br />limit that the Finance Director is authorized to waive She explained it is <br />staff's policy to waive the penalties the first time that a company is late <br />However, she stated the David Drye Company has been late on two previous <br />occasions. <br /> <br /> WON NOTION of Commissioner Privette, seconded by Commissioner and <br />unanimously carried, the Board denied the request by David Drye Company to waive <br />the penalties for the late filing of occupancy tax for Mainstay Suites ($298.95) <br />and Sleep Inn ($478 65). <br /> <br />(O-4) Consideration of Bids for the Fo~-mer Cabarz-us Bank and Tr%tst Buildin~ <br /> <br /> Jonathan Marshall, Commerce Director, reported that three bids, including <br />one verbal bid, were received for the former Cabarrus Bank and Trust Building <br />(currently occupied by Wachovia) at 57 Union Street South. Stating these bids <br />meet or exceed the County's proposed price of $1.1 million for the bulldlng, Mr. <br />Marshall suggested a time be scheduled for the bidders to nuake a presentation to <br />the Board regarding their development plans <br /> <br /> Commissioner Carpenter stated she is an employee of Wachovia. <br /> <br /> U~ONMOTION of Co~issloner Carpenter, seconded by Com~L%ssioner Carruth and <br />unanimously carried, the Board voted to meet on March 8, 2004, at 6:00 p.m. in <br />the Multipurpose Room for presentations by potential buyers of the former <br />Cabarrus Bank and Trust Building. <br /> <br />(G-5) Exchange of County-Owned Property on Bradford Road <br /> <br /> Mr. Marshall advised that County staff and the staff of the Water and <br />Sewer Authority of Cabarrus County (WSACC) have been working w~th Charles <br />Bradford on the exchange of County-owned street frontage property (.84 acre) for <br />additional buffer property (.84 acre) off Bradford Road. General Statute 153A- <br />176 (with direct reference to GS 160A-271) permits this type of property <br />disposition to be accomplished by resolution. <br /> <br /> The Public Notice stating the Board's intent to consider a resolution for <br />an equal exchange of property at its Februaz~ 16~h meeting was published in THE <br />INDPENDENT TRIBUNE on February 6 and February 13, 2004. <br /> <br /> UI:ON NOTION of Commissioner Pr~vette, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the following Resolution and <br />authorized the County Manager to sign all transfer documents related to the <br />exchange of property with Charles Bradford. <br /> <br /> Resolution No. 2004-09 <br /> RESOLUTION ALV~HORIZING <br /> BR3%DFORD ROAD PROPERTY EXCFJ~NGE <br /> <br />WHEREAS, Cabarrus County owns property off Bradford Road that serves as a buffer <br />area for Lake Howell, and; <br /> <br />W~EREAS, Charles Bradford owns property off Bradford Road adjacent to that land <br />owned by Cabarrus County, and; <br /> <br />WHERF~AS, Mr. Bradford has agreed to an equal exchange of approximately .84 acre <br />(County Parcel Identification Nun~0er 4682-83-4239) for approximately .84 acre of <br />property (Lake Howell Buffer Area) w~th Cabarrus County, and, <br /> <br />WHEREAS, the property owned by Mr Bradford and that owned by Cabarrus County are <br />of equal monetary value, and; <br /> <br />WHEREAS, the property that Mr. Bradford would transfer to Cabarrus County is of <br />equal or greater value as a buffer for Lake Howell; and <br /> <br />WHEREAS, the County may exchange real property belonging to the County for other <br />real property by private negotiation if the County receives full and fair <br />consideration in exchange; and <br /> <br />WHEREAS, a notice of the Board's intent to consider a resolution authorizing the <br />Exchange was published in ~ INDEPENDENT TRIBUNE on February 6 and February 13, <br />2004; and <br /> <br />WHEREAS, no one has objected to the Exchange in advance of the regular meeting <br />of the Board of Commissioners scheduled for 6:30 p.m. on February 16, 2004. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Cabarrus County Board of Commissioners <br />agrees to the transfer of County property to Charles Bradford in exchange for an <br />equal amount of property and authorizes the County Manager to sign all transfer <br />documents related to this exchange of property. <br /> <br /> <br />
