(I-2) Cabarrus County Justice Facilities Pro~ect U~date <br /> <br /> Sheriff Brad Riley stated the need to look for more "stopgap" measures to <br />address the jail overcrowding. He reported the Gaston County Detention Center <br />is full and can no longer accept prisoners from Cabarrus County. <br /> <br /> There was brief discussion regarding the proposed plans to build a <br />jail/justice center complex and the immediate need for additional jail space. <br />This issue will be further discussed at the work session on February 23. <br /> <br />(J) GE1TEP. AL COMMENTS BY BOA/ID M~MBEES <br /> <br />There were no comments by the Board. <br /> <br />(K) WATER & SBT~ER DISTRICT OF C;tBA~RUS CO~1%~fY - REGULAR MEETING <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Carpenter and <br />unanimously carried, the Board recessed the meeting of the Board of Commissioners <br />at 9 10 p m. until the conclusion of the meeting of the Water and Sewer District <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette and <br />unanimously carried, the meeting of the Board of Commissioners was reconvened at <br />9:12 p.m. <br /> <br /> (L) CLOSED SESSION <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Suggs and <br />unanimously carried, the Board moved to go into Closed Session to discuss <br />personnel matters as authorized by North Carolina General Statute 143- <br />315.11(a)(6). <br /> <br /> UPON MOTION of Commissioner Prlvette, seconded by Vice Chairman Suggs and <br />unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />County Attorney En~loyment Agreement <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs with <br />Commissioner Privette, Vice Chairman Suggs and Chairman Freeman voting for and <br />Commissioners Carpenter and Carruth voting against, the Board approved the <br />following Employment Agreement between Cabarrus County and Marilyn D. Porter as <br />amended <br /> <br /> AGREEMENT <br /> <br />THIS EMPLOYMENT AGREEMENT, made and entered into effective the 16=h day of <br />February, 2004, by and between the COUNTY OF CABAP. RUS, NORTH CAROLINA, herein <br />called "EMPLOYER" and Marilyn D. Porter, herein called "EMPLOYEE" <br /> <br /> WITNESSETI{: <br /> <br />WHEREAS, the CA~ARRUS COUNTY BOARD OF COMMISSIONERS (the "BOARD',) desires to <br />retain the services of Marilyn D. Porter as County Attorney for Cabarrus County, <br />North Carolina (the ,,County") and they expect that she will continue to se~-ve in <br />that capacity on a full-time basis and discharge the duties of that office during <br />her tenure in that position; and <br /> <br />WHEREAS, it is expected that various complicated technical and legal matters will <br />be raised in conjunction with the duties and responsibilities assumed by the <br />County Attorney and many of these matters will require the assistance and <br />cooperation of the EMPLOYEE long after her employment with the County has ended; <br />and <br /> <br />W}{EREAS, the EMPLOYER and EMPLOYEE consider it prudent to enter into an agreement <br />to assure continuous harmonious and effective performance of the County's legal <br />affairs in the event of the termination or resignation of the EMPLOYEE as County <br />Attorney; and <br /> <br />WHEREA~, both parties recognize the professlonal nature of the position of County <br />Attorney and that the recruitment and employment of an individual in the capacity <br />of County Attorney requires a lengthy and involved process. The parties further <br />recognize that the EMPLOYER makes a ma3or investment of time, effort and public <br />dollars in recruiting, selecting and compensating the EMPLOYEE and the EMPLOYEE, <br />by accepting the position of County Attorney appointed by the BOARD, does not <br />have the security afforded to her that the majority of County employees have, as <br />provided in the Cabarrus County Personnel Ordinance; <br /> <br />NOW THEREFORE, in consideration of the premises and mutual covenants and <br />agreements contained herein, it is mutually covenanted and agreed by and between <br />the parties hereto as follows. <br /> <br /> <br />
