Staff Report to the Cabarrus County Board of Commissioners <br />Petition C2004-03 (Street Naming) <br />Monday, May 17t~, 2004 <br /> <br />Request for an unnamed easement located off of the 10100 block of Flowes Store Rd. <br />The petitioner, Mrs. Joanna Spencer, has requested that this easement be officially <br />named Winding Trail Lane. <br /> <br />The easement has been calculated at approximately 7710 feet. (This number was <br />calculated by using the measurement tool in the ArcView Geographic Information <br />System.) The petition has been signed by the following property owners; their street <br />frontage is listed as well. <br /> <br />Joanna Spencer 585' <br />Carolyn Soalt-Zicherman 1435' <br />Saundra Shultz 30' <br />Susan Patton 40' <br /> <br />TOTAL 2090' <br /> <br />Percentage of Property Owners Signed <br /> <br />27% <br /> <br />It has been our policy that the owners of 51% of the total street frontage sign the petition <br />before we process it. Although the 51% requirement has not been met in this case, the <br />Planning Staff feels that there are too many residences (eight residences) being accessed <br />offofthis easement and that it needs to be officially named. The petitioner has bought <br />property that is accessed by this easement to build a residential structure on. There were <br />several issues that have brought us to our recommendation: <br /> <br />1. The petitioner has health complications that require immediate response should E-911 <br /> services have to be called. <br />2. There is no room to issue the petitioner an address for her residential structure <br /> because all the numbers in that range are presently being used. The easement will <br /> inevitably have to be re-addressed. <br />3. There are a significant number of residential structures in use on this easement, <br /> therefore the planning staff feels that the easement needs to be officially named. <br /> <br />We have referred to N.C.G.S 153A-239.1 Naming roads and assigning street numbers <br />in unincorporated areas for counties. This statue gives the Board of Commissioner's <br />the authority to name this easement as long as a public hearing is held, newspaper <br />advertisements are published, and proper notification is sent to the adjacent property <br />owners. <br /> <br />Staff Recommendation: Staff recommends that this petition be Approved. <br /> <br /> <br />
