GENERAL ASSEMBLY OF NORTH CAROLINA <br /> SESSION 2004 <br /> <br />HOUSE/SENATE BILL <br /> <br />Short Title: Medicaid County Cost Share. (Public) <br />Sponsors: <br /> <br />Referred to: <br /> <br />A BILL TO BE ENTITLED <br /> <br />AN ACT TO PHASE-OUT THE COUNTY COST SHARE FOR THE MEDICAID PROGRAM <br />OVER A FIVE-YEAR PERIOD AND TO PROVIDE IMMEDIATE RELIEF FOR TmR ONE <br />(1) COUNTmS. <br /> <br />The General Assembly of North Carolina enacts: <br /> <br /> SECTION 1. Notwithstanding any other provision of law to the contrary, the cost share of <br />the Medical Assistance Program, excluding the administrative costs, borne by the counties shall <br />be as follows: <br /> <br />(1) Three percent (3%) for Tier 1 counties, effective July 1, 2004. <br />(2) Four percent (4%) for all counties, effective July 1, 2005, except Tier 1 counties shall <br /> pay two percent (2%). <br />(3) Three percent (3%) for all counties, effective July 1, 2006, except Tier 1 counties shall <br /> pay two percent (2%). <br />(4) Two percent (2%) for all counties, effective July 1, 2007. <br />(5) One percent (1%) for all counties, effective July 1, 2008. <br /> <br />Effective July 1, 2009, the nonfederal cost share of the Medical Assistance Program, excluding <br />administrative costs, shall be borne by the State. <br /> <br /> SECTION 2. Effective July 1, 2009, G.S. 108A-54 reads as rewritten: <br />"S 108A-54. Authorization of Medical Assistance Program. <br /> The Department is authorized and empowered to establish a Medical Assistance Program from <br />(federal, state and county) federal and state appropriations and to adopt mles and regulations <br />under which payments are to be made in accordance with the provisions of this Part. Pending <br />full assumption of nonfederal Medicaid Program costs by the state effective July 1, 2009, the <br />boards of county commissioners shall levy, impose and collect the taxes required for the special <br />purpose of medical assistance as provided in this Part, in an amount sufficient to cover each <br />county's share of assistance." <br /> <br />SECTION 3. This act is effective when it becomes law. <br /> <br /> <br />
