Location and siting. Each minipark should be centrally located and easily <br />accessible so that it can be conveniently and safely reached and used by <br />those persons in the surrounding neighborhood it is designed to serve. <br />Each minipark shall be constructed on fiat, dry land capable of serving the <br />purposes intended by these regulations. <br /> <br />Section 55-102_3, Exemptions <br /> <br />Residential developments with minimum one acre or larger lots, while encouraged to <br />incorporate recreational areas, are exempt from these requirements. Further, nothing <br />within these regulations should be construed as preventing the establishment of <br />additional recreational amenities. <br /> <br />Section 66--t4~3_4. Ownership and maintenance <br /> <br />Ownership. Recreational facilities established on subdivision plats shall remain under the <br />ownership and control of the developer (or his successor) or a homeowners' association <br />or similar organization. <br /> <br />Maintenance. The person or entity identified as having the right of ownership and control <br />over a development's recreational and open space area shall be responsible for the <br />continuing upkeep and proper maintenance of the same. <br /> <br />Section 66-t045. Homeowners' association <br /> <br />In the event a homeowners' association or similar legal entity is to be responsible for the <br />maintenance and control of recreational facilities established under these regulations, the <br />association shall be established in conformance with the following: <br /> <br />When created. Provision for the establishment of the association or similar entity is made <br />before any lot in the development is sold or any building occupied. <br /> <br />Authority. The association or similar legal entity has clear legal authority to maintain and <br />exercise control over such common areas and facilities. <br /> <br />39/ <br /> <br /> <br />
