Ordinance No. 2004- <br /> <br />Petition C04-04 (T) <br /> <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarms County Zoning Ordinance is hereby amended as follows: <br /> <br />A) CHAPTER NINE: LANDSCAPING <br /> <br />1) Renumber Parts IV and V to Parts V and VI respectively. In addition, each subsequent section <br />shall be renumbered in sequence with the following additions. <br /> <br />2) Add new Part IV as follows: <br /> <br />Part IV~ Residential Street Yard Requirements. <br /> <br />Section 9-12. Internal Streets. <br /> <br />Street trees shall be required within developments with average lot sizes of V2 acre or less. These <br />trees shall meet the following requirements: <br /> <br />a) Street trees shall be installed on each side of internal streets at a standard of one shade <br /> tree per fifty feet. <br />b) Shade trees must be 2" to 2.5" in caliper and 10' to 12' at the time of planting. <br />c) Where overhead power lines prevent the installation of shade trees, ornamental trees may <br /> be substituted. These ornamental trees must be 1.5" to 2" caliper for single stem trees or <br /> 1" to 1.5" for multi-stem trees. Either type must be 6' to 8' in height at the time of <br /> planting. <br />d) The street trees shall be placed within a six (6) foot planting strip located between the <br /> back of the curb and sidewalk. Where a sidewalk is not required, street trees shall be <br /> placed at least six (6) feet fi.om the edge of the street. <br />e) For developments with more than 20 required trees a minimum of two tree species shall <br /> be used to prevent loss fi.om disease. <br /> <br />Section 9-13 Existing/External Streets. <br /> <br />All developments shall provide trees along streets that the development has frontage on. These <br />trees shall meet the following requirements: <br /> <br />a) Street trees shall be installed on each side of the street that the development has frontage <br /> on at a standard of one shade tree per fifty feet. <br />b) Shade trees must be 2" to 2.5" in caliper and 10' to 12' at the time of planting. <br />c) Where overhead power lines prevent the installation of shade trees, ornamental trees may <br /> be substituted. These ornamental trees must be 1.5" to 2" caliper for single stem trees or <br /> 1" to 1.5" for multi-stem trees. Either type must be 6' to 8' in height at the time of <br /> planting. <br />d) The street trees shall be placed within a six (6) foot planting strip located between the <br /> back of the curb and sidewalk. Where a sidewalk is not required or does not exist, street <br /> trees shall be placed at least six (6) feet behind the right-of-way line. <br /> <br /> <br />
