PLANNING STAFF REPORT TO <br />MIDLAND PLANNING AND ZONING BOARD <br />Tuesday June 1, 2004 <br /> <br />Stal F Use O~ly <br /> <br />Ai)p~ t~vcd __ <br /> <br />Dc~ted <br />tabled <br /> <br />Staff Recommendation: <br /> <br />Staff recommends approval of the Tucker Chase Subdivision <br />with the following conditions:. <br /> <br />1. That the developer enters into a consent agreement with the <br /> Cabarrus County Board of Commissioners to meet the <br /> Adequate Public Facilities Ordinance requirements for <br /> school facilities. <br />2. In accordance with the Traditional Development Standards, <br /> open space areas shall remain undisturbed except for the <br /> installation of active recreation amenities, utility lines, and <br /> removal of under brush. Disturbance shall be approved by <br /> the Subdivision and/or Zoning Administrator. <br />3. Final driveway permit be obtained from NCDOT. If <br /> requested by NCDOT, a professionally engineered Traffic <br /> Impact Analysis (TIA) will be required. This TIA may <br /> result in additional off site road improvements. <br />4. The townhome maximum density of 8 units/acre was <br /> calculated by utilizing the density bonus permitted per the <br /> definition of a mixed-use development. If the commercial <br /> area fails to meet the requirements of the definition the <br /> maximum permitted density will be reduced to 6 units/acre. <br /> <br />Midland Planning and Zoning Board: <br /> <br />Unanimous approval. Remanded to Cabarrus County Board of Commissioners for consent agreement. <br /> <br /> <br />
