PLANNING STAFF REPORT <br />TO MIDLAND PLANNING AND ZONING BOARD <br />Tuesday June 1. 2004 <br /> to live in than one produced in accordance with typical zoning ordinance <br /> and subdivision controls. <br /> <br />Adherence to <br />Submitted Regulations <br /> <br />If approved, the included district regulations submitted by the <br />applicant will become a condition of the rezoning. These <br />regulations will be illustrated on and approved as part of the <br />preliminary site plan approval process. Modifications to these <br />regulations will be processed in accordance with Chapter three Section <br />3-7 part (e). <br /> <br />Permitted Uses: <br /> <br />The permitted uses for this PUD will be those listed on page 3 of the <br />Planned Unit Development Request. Where noted these uses will be <br />permitted based on standards (PBS). <br /> <br />Compliance with Adopted Land Use Plan <br /> <br />The proposed rezoning to PUD is consistent with the recently approved <br />Midland Land Use Plan 2003. <br /> <br />Infrastructure: <br /> <br />Adequate water and sewer services are available through the City of <br />Concord, however, some agreement may be necessary to facilitate <br />needed upgrades to existing lines or the treatment facility. <br /> <br />Adequate Public Facilities: <br /> <br />Based on the school seat and subdivision inventories adequate school <br />space is currently available to serve the proposed subdivision, <br />however, the number of students generated by this and other proposed <br />developments will strain current facilities. Preliminary approval of this <br />development should be dependent on securing a consent agreement <br />with the Cabarrus County Board of Commissioners to meet the <br />Adequate Public Facilities Ordinance requirements for school <br />facilities. <br /> <br />Infrastructure <br /> <br />A certified Traffic Impact Analysis (TIA) will be required prior to <br />approval of the preliminary Plan. <br /> <br />Conclusion: <br /> <br />The petitioner has requested a rezoning from LDR and O/LC to PUD. <br />If approved the site would allow for a mixed-use planned unit <br />development. The request is consistent with the adopted plan. <br /> <br />Recommendation: <br /> <br />Planning staff recommends that petition M04-07 (R) be <br />APPROVED with the following conditions. <br /> <br />1. That the developer enters into a consent agreement with the <br /> Cabarms County Board of Commissioners to meet the Adequate <br /> Public Facilities Ordinance requirements for school facilities. <br /> This may be completed as a condition of the preliminary plan <br /> approval. <br />2.
